American Airlines rights: EU261, UK261 or US DOT?

Choose the legal regime for an American Airlines disruption from the departure country, actual operating carrier and remedy sought. EU261 is strongest for American-operated flights leaving the EU, EEA or Switzerland; UK261 covers American departures from the UK; US DOT rules can secure refunds after cancellation or significant change but generally do not pay a standard delay award.

What EU261 offers on an American departure

For a covered EU, EEA or Swiss departure, EU261 can provide EUR 250, EUR 400 or EUR 600 after qualifying delay, short-notice cancellation or involuntary denied boarding. It also provides reimbursement or rerouting choices and care such as meals, hotel and transport during defined disruptions.

An American-operated Paris-Dallas flight is covered despite American's US nationality. A Dallas-Paris flight operated by American normally is not. This direction rule should appear at the top of any claim assessment.

Final arrival normally must be at least three hours late for delay compensation. Cancellation uses notice and replacement windows. Extraordinary circumstances can remove the fixed amount but not necessarily care and rerouting.

What UK261 offers on an American departure

UK261 protects flights leaving a UK airport on any carrier. Current fixed amounts are GBP 220, GBP 350 and GBP 520. Long-distance arrival between three and four hours late can reduce GBP 520 to GBP 260.

London-New York operated by American therefore has a viable UK261 route. New York-London operated by American normally does not. If British Airways operates the inbound AA-coded segment, operator status can restore coverage.

Use pounds and the UK legal framework for current Heathrow departures. Do not submit an outdated EU261 template merely because the substantive rules look similar.

What DOT refund rules do and do not do

US rules generally require refund when an airline cancels or significantly changes a flight and the passenger does not accept alternatives. The refund covers unused transportation and eligible ancillary services. Current timing is generally seven business days for credit-card payments and twenty calendar days for other methods.

DOT refund protection is valuable for American-operated US-origin cancellations. It is not a fixed payment for inconvenience. A passenger who arrives six hours late after taking the flight does not automatically receive EUR 600, GBP 520 or a comparable federal amount.

US denied-boarding rules are a separate exception with potential compensation when a passenger is involuntarily bumped from an oversold flight. Their calculation and conditions differ from EU261 and UK261.

Montreal Convention sits beside all three

International baggage delay, loss or damage is usually analysed under the Montreal Convention and carrier conditions. American currently states a 1,519 SDR liability ceiling for covered international claims, subject to proof and legal limits.

Report delayed or damaged baggage promptly. Obtain the 13-character file reference, retain baggage tags and make written claims within applicable deadlines. A journey can fail the EU261 scope test and still support a strong baggage case.

The Convention may also govern proven delay damage in international carriage, but it is not an automatic per-hour payment. Causation, loss and reasonable mitigation must be shown.

One itinerary can contain more than one regime

A round trip from Madrid to Dallas on American illustrates this clearly. The outward Madrid-Dallas flight can fall under EU261. The later Dallas-Madrid return normally falls outside EU261 because American is the non-EU operator. DOT refund rules can still govern a cancellation on the return.

A codeshare itinerary can change operator between directions. The passenger should assess each disrupted operation, not assume one answer for the entire reservation.

For a one-ticket missed connection following a covered European departure, EU261 can use final arrival at the last destination. That is different from a stopover followed days later by the return journey.

The table describes broad categories, not an automatic outcome. Cause, notice, passenger conduct and evidence still matter.

How to write the request

Start with facts that establish the regime. For EU261: “American operated this journey departing Madrid.” For UK261: “American operated this journey departing Heathrow.” For DOT refund: “American cancelled the itinerary, I rejected replacement transportation, and I request refund of unused ticket and ancillary services.”

Do not mix currencies or cite every regime at once. Attach the original ticket, operated-by wording, cancellation or delay evidence, final arrival and the passenger's choice. Ask for a specific response to each distinct remedy.

Current EU reform status

As of 14 August 2026, the adopted EU reform must not be treated as already applicable. Its future nine-month claim-submission period and airline response timetable depend on entry into force and the stated application period after Official Journal publication. Current claims remain governed by existing Regulation 261/2004 and relevant national limitation rules.

This future procedure does not alter today's basic warning about American inbound operation. Apply the law in force on the travel and claim dates.

EU261 is the starting regime because the American-operated flight departs the EU.

Which law covers American from the US to London?

US refund and contract rules are the usual starting point. Fixed UK261 normally does not apply unless a UK or EU airline operated the flight.

Is a DOT refund the same as flight compensation?

No. A refund returns unused transportation after cancellation or significant change; it is not a standard payment for inconvenience.

Can EU261 and UK261 both be paid for one disruption?

Duplicate recovery for the same event is not the goal. Select the regime actually governing the operation and account for any payment already received.
