American Airlines 5-hour delay: refund or continue travelling?

After at least five hours of departure delay on an American Airlines flight covered by EU261 or UK261, a passenger who no longer wishes to travel can choose reimbursement and, where relevant, a return to the first departure point. This is not the same as fixed delay compensation, which normally uses a three-hour final-arrival threshold and a cause test. An American-operated flight starting in the United States is usually outside this European five-hour right.

American is a non-European carrier, but departure from the EU, EEA, Switzerland or UK brings the outward flight within the relevant regime. Arrival in Europe alone is insufficient.

What can be reimbursed if you stop travelling?

When the covered departure delay reaches five hours, the passenger can seek reimbursement of the ticket price for unused parts of the journey. If flown sectors no longer serve the original travel plan, reimbursement can extend to those parts and include a return flight to the first point of departure at the earliest opportunity.

Consider a Madrid-Philadelphia-Phoenix itinerary on one reservation. American predicts an eight-hour delay in Madrid, making a two-day business event pointless. The passenger declines travel and requests reimbursement. The unused complete ticket is the central claim.

Now consider a passenger already partway through a return itinerary when a long delay makes the remaining trip useless. The passenger should explain the original purpose and why completed sectors no longer have value. A return to the first departure point is not an automatic free choice for every inconvenience; it is tied to the journey losing its purpose.

Ancillary services that cannot be used should be identified separately. Seat fees, paid baggage and upgrades need documentary proof and may be handled through the refund channel.

Refund and compensation can coexist

The five-hour reimbursement option answers whether the passenger continues travelling. Fixed compensation answers whether an eligible disruption caused sufficient final delay and whether American can prove extraordinary circumstances. Choosing reimbursement does not automatically erase compensation.

If an ordinary technical problem holds a covered long-haul departure for six hours and the passenger abandons the trip, the facts can support both ticket reimbursement and fixed compensation. By contrast, a five-hour delay caused by a genuine airport closure can support reimbursement and care while excluding the fixed amount.

Do not add the ticket price into a EUR 600 or GBP 520 request without separating the legal bases. Present each sum and remedy clearly.

What happens if you continue?

Passengers who still travel retain care rights during the wait and can later assess fixed compensation from final arrival. They do not normally receive a full refund for transportation they accepted and used. A completed trip can still produce a compensation claim even though the five-hour reimbursement option was declined.

Ask American to protect onward segments and rebook missed connections on the same reservation. Keep the revised itinerary. If the final destination is reached three or more hours late on a covered journey, measure the claim there.

Continuing under protest is not usually necessary, but avoid clicking language that expressly settles all claims. A routine rebooking acceptance is different from signing a broad release.

Care during a five-hour wait

On a covered departure, American should provide reasonable meals and refreshments in relation to waiting time, communication facilities, and hotel accommodation plus transport when an overnight stay becomes necessary. Care is due regardless of whether the underlying cause is extraordinary.

If no voucher or room is offered, request help through staff, chat or phone and preserve the response. Buy modest, necessary items and retain itemised receipts. A card statement proves payment but not what was purchased. Alcohol, luxury dining or an unnecessarily expensive hotel can be challenged.

Care ends when the passenger freely chooses reimbursement and no longer waits for rerouting, except for arrangements intrinsically necessary to implement a return right. Record the timing of your decision.

Do not simply leave the airport

Before abandoning a covered journey:

  1. confirm that departure delay has reached or is certain to reach five hours;
  2. tell American in writing that you choose reimbursement;
  3. ask for confirmation that remaining segments are cancelled without a no-show penalty;
  4. request any required return to the first departure point;
  5. screenshot the delay and available options;
  6. keep proof of the journey's purpose if flown sectors became useless.

Walking away without notification can create a no-show record and cancel later segments. It can also make American argue that the passenger voluntarily failed to travel before the statutory threshold.

United States rules are different

DOT refund rules focus on airline cancellation or significant change where the passenger rejects alternatives. A five-hour delay can be a significant change under current US standards in some circumstances, but the legal route and exact facts must be checked. It is not the same automatic EU261 Article 6/8 structure, and it does not provide a standard inconvenience payment.

For Dallas-Madrid operated by American, do not claim that EU261 grants a five-hour refund merely because Madrid is the destination. Instead, document any cancellation or significant change, reject unwanted alternatives and use the American refund process or DOT framework as applicable.

Examples

London-New York delayed six hours before departure: UK261 can apply. The passenger may continue with care and later test final-arrival compensation, or abandon the trip and request reimbursement. A qualifying non-extraordinary cause can support a separate GBP amount.

Paris-Dallas-San Diego on one ticket, seven-hour Paris delay: EU261 covers the outward itinerary. If the trip no longer serves its purpose, reimbursement can be selected. If the passenger travels, final delay at San Diego is the relevant compensation time.

Chicago-London delayed five hours: American operates from the US. The UK five-hour rule normally does not apply. Check whether American cancelled or significantly changed the flight, whether a refund was requested instead of travel, and what the contract provides.

Evidence checklist

Keep the booking confirmation, ticket receipt, original schedule, delay screenshots, operated-by line and all communications. Save proof of the refund choice, cancelled segments and any return arrangement. Retain care receipts and state whether American offered vouchers.

In the request, distinguish “ticket reimbursement after five hours,” “care expenses” and “fixed compensation.” This makes it harder for a refund response to be treated as an answer to every part of the claim.

Must I wait exactly five hours before requesting reimbursement?

The statutory option is tied to a delay of at least five hours. Obtain confirmation and avoid leaving early without recording American's position.

Can I take the flight and still demand the full ticket price back?

Normally no. A passenger who uses the transportation generally cannot also receive full reimbursement for that same service, though compensation may remain possible.

Does extraordinary weather remove the five-hour refund choice?

Not on a covered EU261 or UK261 departure. Weather can remove fixed compensation, but reimbursement and care rights can remain.

What happens to my return flight if I abandon the outbound journey?

Ask American to document and protect the desired segments. A no-show can cancel later flights, so do not assume the return remains active.

Is five hours enough on an American flight from the US to Europe?

It does not create EU261 or UK261 coverage. US refund rules may help after cancellation or significant change if the passenger declines the alternative.
