Air Serbia changed your flight time: refund and compensation
Short answer: a minor Air Serbia timetable adjustment is usually handled under the fare contract, but a substantial change can amount to cancellation or trigger statutory refund rights. Under EU261 case law, moving departure more than one hour earlier is treated as cancellation. Fixed compensation then depends on territorial coverage, notice and the replacement offered. US DOT and Canadian APPR use their own significant-change and refund rules.

Measure every part of the change

Compare whole itineraries, not only the first sector. A feeder shifted by 30 minutes might produce a six-hour connection in Belgrade and a much later final arrival.
An earlier flight can be cancellation
The Court of Justice has held that bringing a flight forward by more than one hour is a cancellation for EU261 purposes. The passenger loses usable time and must reorganise arrival at the airport in much the same way as after replacement.
For an Air Serbia-operated journey leaving the EU/EEA, apply that rule directly. A Belgrade-origin change normally relies on Serbian passenger legislation and Air Serbia's notice. London departures use UK261, while Canadian and US journeys require their local tests.
A change of 55 minutes is not automatically harmless. Fare conditions, airport change, connection loss and another legal system can still create remedies even if the EU early-flight threshold is not crossed.
Notice affects fixed compensation
If the change amounts to cancellation, current EU261 usually removes fixed compensation where notice was sent at least 14 days before departure. Shorter notice requires analysis of the substitute flight:

The timestamp must show when the message reached the passenger or booking contact. A travel agent's delay in forwarding notice can create factual and contractual issues; preserve both Air Serbia and agent communications.
Notice does not erase the refund-or-rerouting response to a cancelled transport. It only affects the additional fixed amount.
Direction and operator remain decisive
An Air Serbia schedule change on Paris-Belgrade can invoke EU261 because France is the origin. The same change on Belgrade-Paris does not become EU261 through destination alone. If another EU airline actually operates the inbound sector, reassess operator coverage.
On a unitary EU-origin journey through BEG, the new final arrival and connection structure should be compared to the original final destination. Separate bookings generally remain separate.

US and Canadian schedule changes
US DOT requires a refund for a cancelled or significantly changed flight to, from or within the United States when the passenger rejects alternative transport, credit and other compensation. The federal definition includes major international timing changes, airport changes, added connections, downgrade and certain accessibility impacts.
Canadian APPR provides rebooking and refund rights after delays and cancellations, with duties varying by Air Serbia's large-carrier status and control category. Canadian fixed compensation focuses on final delay and carrier control, not the EU one-hour advance judgment.
Do not combine all systems into one assertion. State the itinerary and choose the rule that covers it.
Accept, reroute or refund
Before clicking acceptance, compare:
- total final-arrival difference;
- airport and ground-transport changes;
- connection duration and overnight stay;
- cabin and paid seat;
- visa or entry implications of a new route;
- whether the journey still serves its purpose.
If the alternative works, accept it and keep evidence for any separate fixed claim. If it does not, ask Air Serbia for an earlier comparable route. Where cancellation or local significant-change rules apply, cash reimbursement can be chosen instead of a voucher.
Once the passenger requests and receives a full refund, Air Serbia ordinarily no longer owes carriage on the same ticket.
Evidence and claim wording
Keep PDF copies or screenshots of the original itinerary, revised itinerary, first-notice timestamp and every alternative. Record who sent the notice and whether the booking was made through an OTA.
A structured request should say:
- original departure and arrival;
- replacement departure and arrival;
- number of hours earlier or later;
- airport, connection, cabin and operator differences;
- legal regime selected from direction;
- preferred refund or rerouting remedy;
- fixed compensation requested separately, if applicable.
For a Serbian procedure claim, submit within 90 days of the affected service. If Air Serbia says the change was voluntary, attach the carrier-issued schedule notice and avoid using a passenger-cancellation category.
