Air Serbia diverted flight: transport, arrival and claims
Short answer: when Air Serbia lands at an airport other than the one booked, the carrier should arrange or reimburse necessary transport to the original destination airport or another nearby point agreed with the passenger. For EU261, a diversion to an airport serving the same town or region is not automatically cancellation, but final arrival includes the ground-transfer outcome. Fixed compensation depends on coverage, total lateness and the reason for diversion.

Same-region airport is not automatically cancellation
In case C-826/19, the Court of Justice held that diversion to an airport serving the same town, city or region does not by itself constitute cancellation. The airline must offer transport from the alternative airport to the booked airport or another nearby destination agreed with the passenger.
If Air Serbia does not offer that transfer, reasonable and necessary transport cost can be claimed. Keep the route, receipt and explanation. A luxury private transfer where a suitable carrier bus was waiting may not be proportionate.
Whether airports serve the same region is factual. Distance alone is not decisive; transport links, metropolitan area and booked destination all matter.
Calculate final arrival after ground transport
For EU261 compensation, compare scheduled arrival at the booked airport with arrival there after the carrier's transfer. When the passenger agrees to another nearby destination, use the point and timing established by that agreement.
Example: Air Serbia was scheduled to reach the original airport at 18:00, lands elsewhere at 19:20 and the carrier bus arrives at the booked airport at 22:10. The relevant lateness is not merely 80 minutes at touchdown. Preserve the bus ticket, location history or timestamped arrival evidence.

Direction selects legal coverage
An Air Serbia diversion on an EU/EEA departure falls under EU261. London departures use UK261. A service beginning in Belgrade ordinarily relies on Serbian passenger legislation, while Toronto travel also invokes APPR.
If an EU-origin one-ticket itinerary diverts during a later sector outside the Union, final-destination protection can remain relevant. If the first origin is outside the EU and Air Serbia operates the journey, landing eventually in the EU does not create EU261.
The operating carrier must be checked on a codeshare. A JU number alone cannot assign fixed liability.
Why did Air Serbia divert?
Common causes include destination weather, medical emergency, security issue, airport closure, technical concern, fuel need or ATC instruction. Each has a different compensation analysis.
Air Serbia should identify:
- the concrete trigger;
- when the decision was made;
- why the booked airport was unavailable or unsafe;
- whether another reasonable course existed;
- how ground transport and onward connections were protected;
- what caused any additional delay after landing.
A justified safety diversion can be extraordinary, but poor transfer arrangements afterward may still create reimbursable cost and extended delay.
Refund, rerouting and care
If the diversion effectively ends the original service and onward transport is not provided, request rerouting to the final destination. If travel no longer serves its purpose under the applicable cancellation or long-delay rules, reimbursement may be selected.
Care can include food, communication and an overnight hotel. The carrier should also move passengers between the alternative airport and lodging where required. External weather does not automatically erase those duties under EU261, UK261 or Serbian protection.

Connections and baggage
Notify Air Serbia immediately if the diversion threatens an onward flight on the same reservation. Ask for the entire booking to be protected rather than resolving only the diverted sector.
Confirm where checked baggage will be delivered. If bags stay at the alternative airport or fail to reach the final destination, create a PIR and retain the tag. Transport to recover a bag later should be documented and reasonably mitigated.
Separate onward tickets remain a self-transfer issue. Consequential loss may be considered under insurance or Montreal damages but is not automatically part of fixed passenger compensation.
Evidence for the written claim
Collect the original itinerary, diversion airport, landing and door-opening time, all announcements, Air Serbia transport offer, actual arrival at the booked airport, final connection result and receipts. Map the route if a taxi or train was necessary.
Write separate requests for:
- fixed compensation where final delay and cause support it;
- ground transport to the booked destination;
- meal, hotel and transfer care;
- alternative onward travel;
- baggage-related loss.
For a Serbia-origin flight, file the Air Serbia complaint within 90 days. If the airline refuses solely because “the flight operated,” explain that operation to a different airport does not settle transport and final-arrival obligations.

Is every Air Serbia diversion a cancellation?
