Air Serbia damaged baggage: DPR, seven days and evidence
Short answer: inspect checked baggage immediately after an Air Serbia journey. Report visible damage before leaving the airport, obtain a damage report (DPR) and photograph the bag, tag and carousel area. Then submit a written claim no later than seven days after receiving the baggage. The Montreal Convention's current general limit is 1,519 SDR per passenger, but Air Serbia owes proven repair or value loss rather than the maximum automatically.

Do not wait for a repair shop before recording the airport incident. Damage can be difficult to connect to carriage once the bag has left without a report.

Inspect before leaving arrivals
Check wheels, handles, shell, zips, frame, locks and contents. Photograph the complete bag and close-ups under good light. Keep the baggage tag attached until the claim is resolved.
At the baggage desk provide:
- passenger, ticket and flight details;
- baggage-tag number;
- precise description of damage;
- photographs taken at the airport;
- pre-existing marks distinguished from new damage;
- missing contents, if any;
- contact and delivery information.
Read the DPR before signing. If it says “minor scratches” while a wheel and frame are broken, ask for correction.
Seven days means a written claim, not only a DPR
Montreal Convention Article 31 requires complaint in writing within seven days from receipt of checked baggage in a damage case. The airport DPR is strong immediate notice but should be followed by Air Serbia's written claim process with the monetary request and evidence.
Count calendar days conservatively and submit early. Preserve the portal confirmation, attached files and timestamp. An oral promise that a repair partner will call does not safely replace written notice.
The Convention presumes baggage was delivered in good condition if no timely complaint is made, unless fraud is involved. That makes the seven-day record particularly important.

Air Serbia must assess the facts, not reject every mark as wear. Provide earlier travel photographs or purchase condition where the distinction is contested.
Repair, replacement and depreciation
The purpose is to restore proven loss, not provide a brand-new premium suitcase regardless of age. Air Serbia may offer repair, replacement with an equivalent bag or monetary value after depreciation.
Obtain a written repair estimate stating whether the bag is safe and economically repairable. If irreparable, provide original receipt, model, purchase date, photographs and current comparable value. Explain specialist features such as wheelchair components or protective equipment.
Do not discard the damaged bag until Air Serbia confirms inspection is unnecessary. If storage is impossible or hazardous, notify the carrier and preserve comprehensive photographs before disposal.
Contents damaged or missing
List each item separately with location in the bag, packing method, purchase proof and current value. Fragile, valuable and poorly packed contents can face exclusions or defences under the conditions of carriage and Convention.
For theft or missing items, report the issue to baggage services and, where appropriate, airport police. A police report does not prove carrier liability by itself but records timing and contents.
Medication, documents, jewellery and electronics are often recommended for cabin baggage. Their presence in checked baggage does not make evidence irrelevant, but contractual restrictions and contributory conduct can affect recovery.
The 1,519 SDR limit
The revised Montreal limit is 1,519 SDR per passenger for destruction, loss, damage or delay of baggage. It is a combined ceiling, not 1,519 SDR for the suitcase plus another 1,519 SDR for contents.

SDR conversion changes over time. State the IMF rate relevant to the legal payment date rather than advertising one permanent currency equivalent.
Codeshare, wet lease and successive carriers
For checked baggage carried by successive airlines, Convention rules can permit a claim against the first carrier, last carrier or the carrier on whose segment damage occurred. Preserve all boarding passes and tags.
A partner's logo at the baggage desk can identify a handler without deciding liability. On an Air Serbia wet lease, the aircraft supplier does not automatically become the baggage defendant. Ask which carrier accepted and delivered the checked bag.
If the bag was rechecked during a self-transfer, document its condition at each collection. Damage between separate contracts requires a more precise timing analysis.
Flight disruption and baggage damage are separate
A passenger whose replacement flight arrived late and suitcase was broken may have several claims:
- fixed delay or cancellation compensation where legally covered;
- meal and hotel reimbursement;
- damaged-baggage repair or value loss;
- refund of a paid baggage service not provided.

Submit a complete damage file
Attach the DPR, bag tag, ticket, boarding pass, airport photographs, purchase receipt, repair estimate, contents list and bank details. State date of baggage receipt and written submission so the seven-day period is visible.
If Air Serbia offers an unsuitable replacement, compare size, material and functional features rather than brand prestige. If it refuses for normal wear, point to structural damage and repair evidence.
Court action under Montreal must be brought within two years according to Article 35. Do not assume prolonged repair correspondence stops that period.

Is an airport DPR enough for damaged Air Serbia baggage?
It is essential evidence but should be followed by a written monetary claim through Air Serbia no later than seven days after receipt.
Must Air Serbia buy me a new suitcase?
Not automatically. Repair, equivalent replacement or depreciated value can satisfy proven loss, depending on age, condition and repairability.
Are scratches covered as damage?
