Air Serbia China flights: compensation and Belgrade connections
Short answer: an Air Serbia journey from an EU airport through Belgrade to China on one booking can potentially qualify for EUR 600 under EU261 when final arrival is sufficiently late and no valid extraordinary defence succeeds. The reverse China-Belgrade-EU itinerary normally does not enter EU261 because Air Serbia is not an EU carrier. A journey beginning in Belgrade relies primarily on Serbian passenger law.

Air Serbia's current long-haul network includes Shanghai and Guangzhou. Routes, dates and operating carriers can change, so use the itinerary issued for the actual journey rather than an old flight number.

Direction decides the starting law
| Air Serbia-operated itinerary | Main compensation analysis |
|---|---|
| EU airport-Belgrade-Shanghai on one ticket | EU261 can potentially protect the final destination |
| EU airport-Belgrade-Guangzhou on one ticket | same EU-origin test |
| Belgrade-China direct | Serbian passenger legislation |
| China-Belgrade-EU airport on one ticket | normally outside EU261 because Air Serbia is non-EU |
| EU-Belgrade and separately purchased China ticket | each booking usually has its own endpoint |
| JU code on a sector operated by a partner | identify the actual operator before applying coverage |
Passenger nationality and the country where the ticket was bought do not change EU261 territory. An Australian traveller beginning in Vienna has the same EU-origin analysis as an Austrian traveller. A French resident beginning in Shanghai does not gain EU261 through residence alone.
Why an EU-origin connection can reach China
Court of Justice authority treats connecting flights booked as a unit as a whole for important EU261 purposes. Where the journey starts in the EU, a connection in a third country does not necessarily prevent compensation based on arrival at the final destination, even if the affected later sector is operated by a third-country carrier.
The evidence should show:
- one booking reference or a ticket structure proving unitary carriage;
- origin in EU261 territory;
- China as the final destination on that booking;
- Air Serbia or another identified carrier as operator of each sector;
- scheduled and actual arrival in Shanghai or Guangzhou;
- disruption cause and replacement history.
The Air Serbia missed-connection guide explains the one-booking test in more detail.
When EUR 600 is possible
EU-to-China journeys exceed 3,500 km, placing an eligible case in the EUR 600 distance band. The route length alone does not create entitlement. A delay claim also requires the necessary final lateness, while cancellation uses notice and replacement timing.
| Event | Key fixed-payment question |
|---|---|
| Late feeder into Belgrade | when did the passenger reach the Chinese final destination? |
| China sector cancelled | was the whole EU-origin itinerary one protected booking? |
| Replacement arrives 3-4 hours late | can the long-haul amount be reduced to EUR 300? |
| Replacement arrives over 4 hours late | standard EUR 600 remains the starting amount if eligible |
| External airspace restriction | did Air Serbia prove causation and reasonable measures? |
Compensation is calculated per eligible passenger. A family of three in the EUR 600 category has a potential fixed total of EUR 1,800, independent of ticket price.
The Air Serbia amount guide separates this calculation from refunds and expenses.
The reverse journey is not a mirror image
Shanghai-Belgrade-Paris operated by Air Serbia begins outside the EU. Although it ends in France, Air Serbia is not an EU carrier, so EU261 normally does not cover it. Serbian statutory protection, the carriage contract and the Montreal Convention can still matter.
If an EU airline actually operates the inbound sector, reassess the relevant flight and itinerary. A marketing JU code is not enough; consult the operated-by field.
China may impose consumer, tariff or operational duties of its own, but this page does not promise a nationwide fixed Chinese delay amount. Obtain local advice for a claim based specifically on Chinese law.
Rerouting after a cancellation in Belgrade
If the passenger still wants to reach China, request the earliest workable rerouting in comparable conditions. Ask Air Serbia to consider available partner or alternative routes rather than automatically accepting a multi-day wait. Preserve screenshots of realistic seats and the airline's response.
If the trip no longer serves its purpose, reimbursement can be chosen under the applicable rules. Once refund is selected for the journey, Air Serbia ordinarily no longer has to carry that same refunded transport.
Self-booking an expensive long-haul replacement is risky without documented prior contact. It is strongest where Air Serbia failed to offer effective rerouting, an objectively reasonable option existed and urgency justified the cost.
Care during a Belgrade wait
Air Serbia's passenger-rights notice provides distance-based care and overnight accommodation where the conditions are met. A long China connection disrupted until the following day can require meals, hotel and transport between BEG and the lodging.
The cause does not automatically remove care. A proven external airspace closure may defeat fixed compensation while the traveller still needs accommodation and replacement transport. Request support first and keep itemised receipts if the carrier does not provide it.
For a journey that began in the EU and remains one protected itinerary, EU261 care can continue through the connection. A passenger beginning in Serbia should cite Serbian provisions rather than EU261.
Baggage after rerouting
Confirm whether checked baggage is transferred to the replacement or must be collected. Keep the baggage tag and obtain a Property Irregularity Report if the bag does not arrive in China. A delayed-baggage claim follows Montreal Convention rules and should not be included as an unexplained addition to EUR 600.
Reasonable essential purchases at destination require receipts and a written complaint normally within 21 days after the bag is returned. Valuable contents need proof, and the current general liability limit is 1,519 SDR per passenger unless a special declaration applies.
Claim checklist
Submit the complete itinerary, one-booking evidence, ticket numbers, original and replacement boarding passes, arrival proof, messages and receipts. State why EU261 covers the origin or, for a Belgrade departure, why Serbian passenger law applies.
For the Serbian route, file with Air Serbia within 90 days. For an EU-origin case, also investigate the enforcement and limitation rules connected to the EU departure state. Do not wait for a future EU nine-month rule that had not begun to apply on the review date.
FAQ
Can an Air Serbia flight to China qualify for EUR 600?
Yes, for example when one protected itinerary begins in the EU, exceeds 3,500 km and satisfies final-delay, cause and operator requirements.
Does Shanghai-Belgrade-Paris qualify under EU261?
Normally not when Air Serbia operates the journey, because it begins outside the EU and Air Serbia is not an EU carrier.
Is Belgrade always the final destination for compensation?
No. On one booking to China, Shanghai or Guangzhou can be the protected final destination. Separate tickets ordinarily produce separate endpoints.
Can Air Serbia reduce EUR 600 to EUR 300?
In a qualifying long-haul rerouting case, the current rules permit a 50 percent reduction when final arrival is no more than four hours late.
Is delayed baggage included in flight compensation?
No. Baggage has its own Montreal Convention evidence, deadlines and loss calculation. Report it at the destination and keep the PIR and receipts.
