Air France US flight claims: EU261 compensation and DOT refunds

Short answer: an Air France-operated flight between the United States and the EU can qualify for EUR 600 under EU261 in either direction, subject to delay, cancellation, cause and itinerary. US DOT rules separately require refunds for cancelled or significantly changed US itineraries when the passenger does not accept the changed travel. DOT refund rights are not a US version of fixed EU261 delay compensation.

The joint venture, SkyTeam membership and an AF flight number do not replace “operated by.” Save the e-ticket wording before travel.

EU261 fixed compensation

Most nonstop US–France journeys exceed 3,500 km. An eligible Air France-operated delay or short-notice cancellation can therefore begin in the EUR 600 category. Long-haul arrival between three and four hours can reduce the amount to EUR 300 under the statutory conditions.

The usual delay test is final arrival at least three hours late. On one booking from the United States through Paris to another EU destination, assess the last ticketed destination. If a New York–Paris delay causes a missed connection to Rome and arrival in Rome is nine hours late, Rome can be the relevant endpoint.

Air France can defeat the fixed amount by proving extraordinary circumstances and reasonable measures. External ATC restrictions or severe weather may qualify. Ordinary technical faults, crew planning and routine aircraft rotation usually require more than an operational label.

What US DOT refunds cover

DOT requires a refund when the airline cancels or significantly changes a covered flight and the passenger does not accept the changed itinerary, rebooking, voucher or other alternative compensation. The refund concerns the unused ticket and eligible ancillary fees, not inconvenience calculated by distance.

DOT’s current significant-change examples include:

  • an international flight departing six or more hours earlier or arriving six or more hours later;
  • a changed origin or destination airport;
  • an increased number of connections;
  • downgrade to a lower class;
  • certain accessibility-related connection or aircraft changes.

The passenger is not entitled to the same ticket refund after accepting and taking the rebooked travel. That does not decide a separate EU261 fixed claim.

Automatic refund timing

DOT guidance states that, when a refund is owed and the passenger does not accept an alternative, it should be automatic in the original payment form. The general timing is seven business days for credit-card purchases and 20 calendar days for cash, cheque or debit-card purchases.

Air France’s US Customer Commitment mirrors those periods for eligible refunds. Preserve the offer and passenger response, because automatic processing depends on Air France knowing that the alternative was not accepted.

If an agent issued the ticket, DOT obligations can involve the merchant of record or ticket agent. Identify the 13-digit ticket number, issuer and payment recipient instead of sending identical refund demands without context.

The 2026 renumbering update

DOT announced on 8 July 2026 that it extended temporary enforcement discretion through 7 July 2027 for a narrow issue: a flight number change that technically counts as cancellation under the current rule where the passenger is successfully rebooked and the flight operates without a significant change or delay.

This does not remove refund rights for a genuinely cancelled or significantly changed itinerary. It also does not alter EU261’s cancellation, notice or delay analysis. Record the old and new flight numbers, schedule and airports rather than treating every renumbering as an automatic payment.

Air France’s US 24-hour option

Air France’s US Customer Commitment states that, for flights to or from the United States booked on airfrance.us, a refund can be requested no later than 24 hours after completing the booking, together with paid options purchased at that time. This is a booking-cancellation protection, not compensation for airline disruption.

Check the point of sale and current conditions. A ticket bought from an OTA or another country site may use a different process. Save the booking timestamp if relying on the 24-hour option.

Care and replacement travel

EU261 care can require meals, hotel and transfer during a qualifying wait even where extraordinary circumstances remove the fixed amount. US federal rules do not create an identical general fixed-care regime for foreign carriers, so check Air France’s passenger-rights notice and US Customer Commitment for the itinerary.

If Air France cancels a covered EU261 journey and the passenger still needs to travel, request rerouting at the earliest opportunity. DOT refund is the appropriate choice when the passenger rejects continued travel; it is not both full transport and full unused-ticket money for the same coupons.

Example: Boston–Paris–Barcelona

Air France operates the transatlantic sector, and all flights are on one ticket. A technical problem causes a missed Paris connection and arrival in Barcelona ten hours late.

Potential requests are:

  1. EUR 600 fixed EU261 compensation per eligible passenger, subject to the cause;
  2. meals and hotel if Air France did not provide care;
  3. no DOT ticket refund if the passenger accepted and completed the replacement journey;
  4. any baggage claim under the Montreal Convention as a separate line.

If the passenger instead rejects a substantially changed itinerary and does not travel, DOT refund rules and EU261 reimbursement can overlap in objective. Seek one full refund, not two recoveries of the fare.

Claims and escalation

Submit fixed compensation and expenses through Air France’s claims route. State the operating carrier, full itinerary and actual final arrival. For a DOT refund issue, identify the cancelled or significant change and confirm that no alternative was accepted.

Air France’s US claims page links passengers to the US Department of Transportation complaint route. DOT forwards service complaints to the airline and uses complaint data for oversight. A DOT complaint is not the same as a private court judgment.

FAQ

Can an Air France flight from the US to Paris receive EUR 600?

Yes, when Air France actually operates the flight and the EU261 delay or cancellation conditions are met. An AF code on a Delta-operated inbound flight is not enough.

Does the United States pay fixed delay compensation like EU261?

US DOT rules principally provide refund and consumer protections rather than an equivalent universal distance-based delay payment. EU261 can separately apply to Air France-operated journeys.

How fast is an eligible US refund?

DOT and Air France’s US commitment state seven business days for credit-card refunds and 20 calendar days for cash, cheque or debit payment.

Can I get a refund after taking the replacement flight?

Not for the same used transport under DOT’s cancelled or significantly changed flight rule. A separate EU261 fixed claim may remain possible.

Does changing the flight number always mean a refund?

Current rules are subject to DOT’s temporary enforcement discretion for certain successful rebookings without significant change or delay. Examine the actual itinerary, not the number alone.
