Air France strike compensation: staff, ATC or airport action

Short answer: an Air France employee strike does not automatically release the airline from EU261 compensation. A lawful strike called by a union representing the carrier's own staff can remain within Air France's control under Court of Justice case law. A strike by French air traffic controllers, airport security or another external body is more likely to be extraordinary, but Air France must still prove that the event caused your disruption and that reasonable measures could not prevent it.

Identify who was on strike

The label "strike disruption" is not enough to decide a claim. Start with the employer and function of the workers involved.

Check the cancellation message, union notice, airport announcement and Air France's written reply. A national news report may confirm that action occurred, but it does not prove why your particular aircraft or crew could not operate.

Air France staff strikes

In Airhelp v SAS (C-28/20), the Court of Justice held that a strike organised under national law by a trade union representing an airline's employees was not an extraordinary circumstance. The action concerned working conditions and pay, matters that form part of the carrier's normal management.

The earlier Krüsemann (joined cases C-195/17 and others) judgment reached a similar result for a spontaneous absence following a restructuring announcement. An event can be unexpected and still remain inherent in airline activity.

These rulings do not make payment automatic after every action involving staff. The itinerary must fall within EU261, and the qualifying delay, cancellation or denied boarding must be linked to the action. Air France may also identify a separate external cause affecting the same flight.

ATC and airport strikes

Air traffic management decisions ordinarily come from authorities outside Air France. A controller strike may reduce arrival rates, close sectors or require cancellations across several carriers. Airport security or border action can likewise restrict operations without being directed by the airline.

Such events can satisfy the extraordinary-circumstances test. Air France must nevertheless show:

  • the precise external event and relevant time window;
  • how it affected the aircraft, crew, airport or route used for your flight;
  • why the selected cancellation or long delay followed from that event;
  • what rerouting, aircraft rotation or schedule adjustments were considered;
  • why the disruption could not be avoided with reasonable measures.

A general reference to "industrial action in France" does not distinguish an Air France employee dispute from external ATC restrictions. Ask the carrier to identify the organisation and the operational measure.

Compensation amounts

When EU261 applies, Air France-controlled strike disruption can lead to the standard payment:

For a long-haul arrival delay between three and four hours, the EUR 600 amount can be reduced by half. On a protected connection, measure arrival at the final destination shown on the same booking. Read the Air France amount guide before calculating a multi-sector claim.

Cancellation choices do not depend on fault

If Air France cancels, it should offer the Article 8 choice between:

  • reimbursement for the unused ticket, with a return flight where the completed journey no longer serves its purpose;
  • rerouting at the earliest opportunity in comparable conditions;
  • rerouting on a later date chosen by the passenger, subject to seats.

Do not accept a refund simply because the app presents it first if you still need to travel. Once you freely choose reimbursement, the airline normally no longer has to carry you to the destination under that cancelled booking. Take screenshots of the options and ask for a workable route in writing.

Meals and hotel during a strike

The right to care applies even where an external strike is extraordinary. Depending on the wait, Air France should provide reasonable meals, communication, accommodation and transport between the airport and accommodation.

Ask at the service desk or through the airline's digital channels. If no effective assistance is available, buy reasonable necessities and keep itemised receipts. Luxury lodging, alcohol and unrelated purchases are harder to recover. Record that assistance was requested and unavailable.

Knock-on cancellations need a causal chain

Your flight may operate after the announced strike period but use an aircraft or crew delayed earlier. An extraordinary event can affect a later rotation, yet the carrier must establish the link rather than rely indefinitely on the original disruption.

Ask for the affected preceding flight, the restriction period and the steps taken to restore the schedule. The longer the interval, the more important the evidence about reserve crew, aircraft positioning and alternative carriage becomes. Reasonable measures do not require unlimited resources, but they require a response proportionate to Air France's operation.

Evidence to preserve

Keep a compact claim file containing:

  1. booking confirmation, ticket number and all boarding passes;
  2. the original itinerary and every replacement offered;
  3. emails, texts and app notices naming the strike;
  4. actual arrival time at the booked final destination;
  5. receipts for meals, hotel and transfers;
  6. any Air France refusal and claim reference;
  7. reliable airport or authority notices for the relevant date.

Avoid claiming that all French strikes qualify in the same way. State who took action, what happened to the booked journey and why the available evidence contradicts or supports the defence.

How to answer a strike refusal

A useful reply asks Air France to specify whether the action involved its own staff, an external authority or a contractor. If the airline relies on ATC restrictions, request the applicable flow measure or airport limitation and its connection to your flight. Also ask what reasonable rerouting was examined.

Where the action was called by a union representing Air France employees, cite C-28/20 and request reconsideration. Where the evidence points to controllers or airport security, focus on care, rerouting and the adequacy of the airline's response rather than assuming the fixed payment is certain.

FAQ

Does an Air France pilot strike qualify for compensation?

It can. A lawful union strike by an airline's own employees is not automatically extraordinary under C-28/20, provided the other EU261 conditions are met.

Is a French ATC strike always exempt?

No result is automatic. ATC action is generally external, but Air France must prove the event, its causal link to the flight and reasonable measures.

Can I recover hotel costs during an external strike?

Yes, reasonable care can remain due even when fixed compensation is excluded by extraordinary circumstances. Keep receipts and proof that effective assistance was unavailable.

What if Air France notified me more than 14 days before cancellation?

The notice may remove fixed cancellation compensation, but the choice of reimbursement or rerouting remains. Care depends on the actual waiting circumstances.

Can a strike affect a flight scheduled the next day?

Possibly, through aircraft or crew rotation, but Air France must show a real causal chain and the measures taken to restore operations.
