Air Canada delayed flight compensation: which system pays?

Short answer: a delayed Air Canada flight can produce up to EUR 600, GBP 520 or CAD 1,000 per passenger, but not because every three-hour delay receives the highest figure. First identify the protected itinerary and operating carrier. Then measure arrival at the final destination and classify the cause under the applicable EU, UK or Canadian rule.

Skipping the first question creates the most common error. Toronto-Paris on Air Canada is not an EU261 claim simply because it lands in France. Paris-Toronto on the same airline can be covered because it departs the EU. Toronto-Paris operated by an EU carrier may produce a different answer from the Air Canada-operated return.

Three hours does not mean the same thing everywhere

Under current EU261, a passenger who reaches the protected final destination at least three hours late can qualify for fixed compensation, subject to cause and other defences. On a long-haul Europe-Canada journey, three to four hours can lead to a reduced EUR 300 amount; four hours or more can support EUR 600.

Under current UK261, the comparable long-haul amounts are GBP 260 for three to four hours and GBP 520 for four hours or more.

For Air Canada as a large carrier under APPR, compensation for a controllable delay not required for safety uses these bands:

The Canadian amount also depends on when notice was given and how the event is classified. A timetable of hours alone is not enough.

Measure the destination Air Canada promised on one ticket

Suppose the booking is Rome-Montreal-Ottawa. A late arrival in Montreal causes a missed connection, and the passenger reaches Ottawa eight hours late. If the sectors form one reservation, Ottawa is normally the useful endpoint for the arrival comparison. If the Ottawa ticket was purchased separately, the European claim may stop at Montreal.

Cause analysis differs between EU261 and APPR

EU261 asks whether the airline proves extraordinary circumstances and that the delay could not have been avoided even if all reasonable measures had been taken. Severe weather, airport closure or binding air-traffic restrictions can qualify. Routine aircraft defects and ordinary crew planning are generally part of airline operations, although every case needs evidence.

APPR uses three categories:

  1. Within airline control and not required for safety: compensation, assistance and rebooking can apply.
  2. Within airline control but required for safety: assistance and rebooking can apply, while fixed APPR compensation normally does not.
  3. Outside airline control: rebooking and refund obligations can remain, but compensation and standards of treatment differ.

Ask Air Canada to identify the event, the affected aircraft or crew, when it arose and why it caused the complete arrival delay. “Operational reasons” is a description, not a factual explanation.

Delay rights while the passenger is waiting

For a covered EU or UK departure, care depends on distance and departure delay. A transatlantic flight normally reaches the four-hour care threshold, but a cancellation or rerouting can create duties sooner under its own facts. Required care includes reasonable food, communication and, when an overnight wait becomes necessary, accommodation and transfers.

Under APPR, assistance can begin after a two-hour wait for delays within airline control, including safety-related control, provided the passenger was informed less than 12 hours before departure. The current Canadian guidance includes reasonable food and drink, communication and overnight accommodation where required.

Always ask Air Canada first. If effective help is unavailable, preserve screenshots of the request, buy proportionate necessities and retain itemised receipts. Alcohol, luxury rooms and unrelated purchases are difficult to recover.

Five hours can create a travel choice under EU or UK rules

On a covered EU261 or UK261 departure delay of at least five hours, a passenger may decide not to travel and request reimbursement for the unused journey, with a return flight to the starting point where required. That choice is different from accepting a later flight.

Do not cancel the booking through a voluntary self-service option before recording the disruption and the choice offered. A voluntary cancellation can make the file look like a passenger decision rather than a statutory refund request.

Build the timeline before filing

Use a compact table in the claim:

Attach the booking, operated-by line, all boarding passes, disruption messages, receipts and the Air Canada case confirmation. For several passengers, list each traveller and requested amount separately.

Worked examples

EU departure

A passenger travels Berlin-Montreal on Air Canada and arrives five hours late after a routine aircraft issue. The EU departure makes EU261 relevant. If Air Canada cannot establish extraordinary circumstances, EUR 600 may be the correct long-haul amount. APPR may also be considered, but there should be no duplicate recovery for the same inconvenience.

Canada departure

A passenger travels Montreal-Berlin on Air Canada and arrives five hours late for a controllable, non-safety event. EU261 normally does not cover that direction because Air Canada is not an EU carrier. APPR may instead support CAD 400.

Partner operation

A Toronto-Frankfurt ticket has an AC code but is operated by Lufthansa. The operated-by line can change the EU261 analysis for the inbound journey. Send the statutory claim to the performing carrier, not automatically to the airline whose code is largest on the ticket.

FAQ

Does a three-hour Air Canada departure delay guarantee compensation?

No. Fixed compensation normally turns on arrival at the protected final destination, the governing regime and the cause, not departure delay alone.

Is landing time the EU261 arrival time?

Not necessarily. European case law links arrival to at least one aircraft door opening so passengers can leave, rather than touchdown alone.

Does APPR apply to an Air Canada flight from Europe?

APPR applies to flights to, from and within Canada. A Europe-origin itinerary may therefore require both APPR and EU261 analysis, without duplicate compensation for the same event.

Can weather remove Air Canada's duty to provide a hotel?

It may remove fixed compensation under a particular regime, but it does not automatically erase every rerouting, refund or care duty. Check the rule that covers the flight and keep reasonable receipts.

What if Air Canada says the delay was required for safety?

Ask for the underlying event and timing. APPR distinguishes safety-related control from ordinary controllable events, while EU261 uses a different extraordinary-circumstances test.

How long do I have to request APPR compensation?

Send the written request to Air Canada within one year of the delay. The airline then has 30 days to pay or explain why compensation is not payable.
