Air Arabia Maroc delay over five hours: refund or continue travelling
After an Air Arabia Maroc flight covered by EC261 has been delayed for at least five hours at departure, a passenger who no longer wants the trip can normally choose reimbursement and, when relevant, a return to the first departure point. A traveller who continues the journey keeps care rights and can still test arrival-delay compensation separately. The five-hour rule is not itself an automatic EUR 250 or EUR 400 payment.

The five hours are measured at departure. That differs from the three-hour arrival threshold used for fixed delay compensation. A passenger can therefore gain the right to abandon travel before knowing whether final arrival would have crossed three hours.
When reimbursement makes sense
Reimbursement is appropriate when the journey no longer serves its original purpose. A same-day event may be over, a short weekend may have become pointless, or a connection may no longer be usable. Explain the purpose briefly and objectively. Keep proof where relevant, such as an event time or onward booking.
For a continuous protected journey that has already partly been flown, EC261 can require reimbursement of parts that no longer serve the original plan and a return flight to the first point of departure. This is not a general right to keep valuable travel and also recover its price. Map used and unused sectors clearly.
Do not confuse airline-caused delay with voluntary passenger cancellation. If the passenger gives up before the statutory threshold without another legal basis, the fare conditions may control the refund. Save a timestamp showing when the five-hour point was reached and what the airline displayed.
Continuing does not erase other claims
A passenger may wait and fly. That choice does not automatically waive fixed compensation if final arrival later reaches three hours and the cause remains within airline responsibility. It also does not remove care during the wait.
Meal and communication duties begin at shorter waiting thresholds depending on route distance. If an overnight delay becomes necessary, accommodation and transfers may be required. Ask Air Arabia for assistance first; when it is not provided, buy reasonable essentials and keep itemised receipts.

Direction limits the five-hour remedy
EC261 applies to an Air Arabia Maroc departure from the EU regardless of the carrier's Moroccan licence. A direct 3O departure from Morocco to the EU normally lies outside the regulation. UK departures must be assessed under UK261.
If the delayed itinerary includes multiple flights, identify the journey origin and whether every sector belongs to one reservation. Two PNRs should not be silently presented as one protected trip. The operator of each segment also matters.

Rerouting and self-funded alternatives
When the traveller still needs to arrive, ask for rerouting rather than reimbursement. Record every flight, bus or other route offered and its arrival. The earliest reasonable option is not always another service bearing the Air Arabia logo, although comparable conditions and availability must be considered.

Once a passenger accepts a full cash refund, demanding both that refund and replacement transport can be inconsistent. State which remedy was chosen, whether the airline forced the choice and whether only part of the itinerary was reimbursed.
Evidence and claim structure
Keep the original itinerary, scheduled departure and a timestamp at five hours. Save delay messages, airport screens and any refund or rerouting menu. Record the operated-by company and every proposed replacement.
If abandoning travel, list each unused sector and explain whether completed travel became purposeless. If continuing, preserve final arrival and cause evidence for the separate fixed-payment assessment. Add receipts for care but do not bury them inside the ticket-price calculation.
Send a concise request with one heading per remedy: reimbursement, return flight, care expenses and fixed compensation. This makes a partial airline response visible. Keep the case reference and payment record.
The current legal position was checked on 26 August 2026. The future EU nine-month filing rule is not yet in application and is unrelated to the five-hour threshold in any event.

Does five hours automatically produce EUR 400?
No. Five hours at departure creates a reimbursement choice on a covered flight. Fixed compensation uses final arrival, route, cause and other conditions.
Can I take the delayed flight and still claim?
Yes. Continuing travel does not itself waive a qualifying arrival-delay payment or reasonable care expenses.
Can I demand a refund after accepting rerouting and travelling?
Usually not for the same completed transport. Explain any unused sectors or failure of the replacement rather than seeking two incompatible remedies.
Does the five-hour EC261 rule cover a direct departure from Morocco?
Normally not when Air Arabia Maroc operates it, because 3O is non-EU and the flight starts outside the Union. Check fare and contract rights instead.
What proof shows that the trip no longer served its purpose?
The itinerary and timing may be enough, but event tickets, meeting times or an onward booking can clarify why travel after the delay had no practical value.
