United Express operating carrier: who is responsible for a claim?

United Express is a regional service brand, not proof that United Airlines, Inc. operated the aircraft. Read the ticket and boarding pass for the named regional carrier. On a Europe-origin connecting journey, the United Express segment can remain within EU261, but the legal operator, final destination and booking structure still need to be proved.

Regional partner rosters change. Do not rely on a remembered list. Preserve the operator printed for the incident date. Public sources have listed carriers such as SkyWest, Republic, CommuteAir and GoJet in United Express contexts, but the document for the specific flight is stronger than a generic roster.

Why the operator matters under EU261 and UK261

Obligations generally rest with an operating air carrier, but a connecting journey split between different airlines requires a respondent analysis rather than a flight-number shortcut. If a regional airline performed the delayed sector, its role is legally relevant even when United sold and managed the itinerary; that fact alone does not prove which carrier owes compensation for the whole journey.

That does not mean the passenger must ignore United's service channels. United may handle rebooking, baggage and customer communication under commercial arrangements. For a disputed fixed claim, however, identify the performing airline and preserve any response assigning responsibility.

Codeshare and capacity-purchase arrangements behind the scenes do not remove passenger rights. The operator can seek contractual recovery from another party after paying a valid claim.

EU-origin connection on United Express

Consider Frankfurt-Chicago-South Bend on one ticket. United operates the transatlantic sector and a regional carrier operates the United Express connection. If the regional sector creates a final delay over three hours, EU261 can still cover the directly connecting journey because it began in the EU.

C-561/20 made non-EU United liable where United operated the entire EU-origin connecting journey. It does not by itself decide a case in which United and a separate regional carrier split the sectors. C-502/18 shows that, in a code-share journey performed by different airlines, the carrier that performed the first covered flight can in defined circumstances answer for final delay caused on the later non-EU leg. Preserve both operated-by entries and the contractual structure instead of naming the regional carrier automatically.

Provide the complete ticket and operated-by line rather than submitting only a screenshot with the UA number.

UK-origin connection

Heathrow-Newark-US regional city on one booking can fall under UK261. If the United Express sector causes the missed connection or long final delay, name its operator and calculate arrival at the final city.

The reverse US city-Newark-Heathrow journey starts in the United States. United and most United Express operators are US carriers, so fixed UK261 normally does not apply unless a qualifying carrier actually operates the inbound protected flight.

Mainline delay versus regional delay

Establish the root event:

  • late transatlantic arrival causes the regional connection to be missed;
  • regional mechanical issue delays the onward flight;
  • ATC restriction affects the hub;
  • United rebooks to a regional service that later fails;
  • baggage or immigration, rather than airline operation, causes the missed boarding.

This chronology affects cause and respondent. Do not assume the last cancelled flight alone created every hour of delay.

United Express and extraordinary circumstances

Routine mechanical defects remain ordinary operating risks unless an external feature qualifies. Weather or ATC can be extraordinary, but the operator should establish the specific restriction and reasonable measures.

If one carrier relies on a disruption affecting another sector, request the chain. A generic "late arriving aircraft" message does not identify the root cause or prove the defence.

Care, rerouting and reimbursement can survive an extraordinary event on a covered journey.

Rebooking and airport assistance

At the hub, United's systems commonly handle the itinerary. Ask for earliest rerouting to the final destination and keep both United and regional-carrier communications. If directed to a different counter or form, record who gave that instruction.

For overnight waits, request hotel, meals and transport where the covered regime requires care. Expenses should be reasonable and itemised. A passenger should not be forced to guess the contractual allocation between United and its regional partner before receiving urgent assistance.

Baggage issues on a regional sector

Report baggage at the final airport and obtain a file reference. The last carrier and commercial handling arrangements can matter, but Montreal Convention rights allow passengers on successive international carriage to proceed under defined rules. Keep every bag tag and sector.

Do not merge bag loss into fixed EU261 compensation. Use United's baggage tools while preserving the operating carrier and international itinerary.

  • screenshot of the full operated-by phrase;
  • final arrival evidence;
  • cancellation or delay reason;
  • United and regional-carrier case numbers;
  • rerouting and care receipts;
  • explanation of why all sectors were one booking.

If the parties refer the claim to each other, reply to both with the evidence and ask each to state its legal basis. A protective submission to United and the named regional carrier can be sensible where the operating and contractual roles remain disputed. Do not let referral consume the national limitation period.

Should I submit the claim to United or the regional carrier?

Identify every actual operator first. Where different carriers split one connection, C-561/20 and C-502/18 require different facts; do not assume that the UA number or the last operator alone determines the respondent.

Does United Express branding change an inbound US-Europe claim?

No by itself. A journey beginning in the US still needs a qualifying inbound operating carrier for EU261 or UK261 fixed compensation.
