United Airlines strike compensation: internal or external action?

A strike involving United's own staff can support EU261 or UK261 compensation on a covered journey, while an air-traffic-control, airport-security or other external strike is more likely to be extraordinary. The result still depends on who took action, what caused your flight to fail, what United could reasonably do and whether the route is within territorial scope.

A United departure from the EU, EEA, Switzerland or the UK is the main claim opportunity. A United-operated strike disruption beginning in the United States normally does not qualify for the European or UK fixed amount.

Do not rely only on a news headline. Your aircraft may have been delayed by an earlier rotation, crew positioning, congestion after the strike or a separate technical problem.

United employee action

European case law does not treat every labour dispute as extraordinary. A lawful strike called by staff representatives over working conditions can be inherent in managing an airline and within its control for Article 5(3), even though United cannot force employees to work.

The same caution applies to sudden internal action. The carrier must explain why the event sits outside normal activity and what measures were available. Calling the action "uncontrollable" is not enough.

This does not mean every internal strike automatically pays. The passenger still needs a covered route, qualifying cancellation or final delay, and a causal link to the strike.

Airport and ATC strikes

United generally does not control public air-traffic controllers, border officers, airport security or an independent airport operator. Restrictions imposed by those bodies can qualify as extraordinary circumstances.

Ask for the exact restriction, location and time window. An ATC strike in France may affect a United aircraft elsewhere, but the airline should show how it constrained your particular route. If the strike ended and the remaining delay came from United's crew or aircraft recovery, the causal chain deserves separate analysis.

Ground handling requires care. Whether workers are effectively part of the airline's organization or an independent external provider can matter. Record the employer named in the notice rather than assuming every person on the ramp works for United.

Scope decides whether a fixed claim exists

United is a US carrier, but any airline can be covered on an EU or UK departure. Frankfurt-Newark operated by United can therefore qualify. Heathrow-San Francisco can qualify under UK261.

Newark-Frankfurt operated by United normally falls outside EU261. Newark-Heathrow operated by United normally falls outside UK261. An internal United strike does not change that territorial boundary.

If Lufthansa or another eligible European carrier actually operates a US-origin codeshare, inbound coverage may differ. Preserve the operated-by line and use the codeshare operator guide.

Notice and cancellations

When strike action causes cancellation, the 14-day notice rules remain relevant to fixed compensation. Save the first message actually communicated to you, not merely the date United decided internally.

Even if an extraordinary external strike removes the fixed award, the passenger can still choose reimbursement or rerouting on a covered cancellation. A travel credit is not the compulsory substitute for cash reimbursement.

For long delay, measure arrival at the final destination of a directly connecting booking. A strike-affected feeder that creates a missed connection can qualify based on total final delay rather than the first sector alone.

Reasonable measures

United should show how it tried to avoid or reduce the disruption without intolerable sacrifice. Relevant questions include:

  • when the strike and operational restrictions became known;
  • whether crews and aircraft were repositioned;
  • whether a reasonable partner route was available;
  • why protected passengers were not transferred;
  • whether later rotation delay was actively reduced;
  • whether priority rules were applied consistently.

The regulation does not require United to settle a labour dispute on the passengers' terms. It does require evidence about the response to the actual event.

Care during a strike

On a covered journey, care is not conditional on United causing the strike. Meals, communications, hotel and airport-hotel transport can be due while the passenger waits for rerouting. Keep itemised receipts if assistance is not provided.

Costs must be reasonable in duration and price. Ask United first, preserve the response and avoid treating a fixed compensation claim as reimbursement for receipts. They are different remedies.

US-origin passengers should check United's assistance, contract, insurance and refund rules. Those may provide practical relief without the EU or UK lump sum.

Evidence and claim wording

Keep the itinerary, boarding pass, notice, actual arrival time, airport messages, official strike notice and every rerouting offer. In your claim, identify the route scope and ask United to state:

  1. whose employees took action;
  2. their employer and role;
  3. the restriction applied to your flight;
  4. the direct causal timeline;
  5. the reasonable measures attempted.

Use the United rejected-claim guide if the response says only "industrial action." A useful rebuttal tests the facts rather than asserting that all strikes pay.

Example: Heathrow to Chicago

A United-operated Heathrow-Chicago departure is cancelled two days before travel during action by United's own flight crew. UK261 can apply because the journey starts in the UK. If United cannot establish an extraordinary event and the replacement does not fit a statutory exception, fixed compensation may be due in addition to rerouting and care.

If Chicago-Heathrow is cancelled on a United-operated return, UK261 fixed compensation normally does not apply to that direction. A refund can still be due if the passenger rejects replacement travel.

Does a United pilot strike qualify for compensation?

It can on a covered route. Action by the airline's own staff is not automatically an extraordinary circumstance.

Is an ATC strike extraordinary?

Usually, because United does not control air-traffic controllers. The airline must still connect the restriction to your flight and consider reasonable measures.

Are meals and hotel due during an external strike?

They can be on a covered journey. The right to care is separate from fixed compensation and fault.

Does a US strike make Newark-Europe eligible under EU261?

No. A United-operated journey beginning in the US normally remains outside EU261 and UK261 regardless of strike type.

What evidence should United provide?

The identity of the strikers, operational restriction, causal timeline and measures taken to reroute or reduce delay.
