United Airlines rights: EU261, UK261 or US DOT?

Use EU261 for an eligible United journey beginning in the EU/EEA or Switzerland, UK261 for one beginning in the United Kingdom, and US DOT rules for refunds, oversales and defined US consumer protections. DOT does not currently mirror the routine EUR 250-600 or GBP 220-520 delay-compensation system.

More than one framework can touch an itinerary, but each remedy must keep its own conditions. Avoid demanding duplicate recovery for the same loss.

EU261: strongest on United departures from Europe

EU261 applies to any operating airline departing the EU or EEA, with relevant Swiss protection under its associated framework. A covered United delay can yield EUR 250, EUR 400 or EUR 600 when final arrival reaches three hours and no extraordinary-circumstances defence succeeds.

Cancellation adds the 14-day notice and alternative-timing tests. Denied boarding protects passengers who presented on time with confirmed reservations and valid documents. Reimbursement, rerouting and care sit alongside the fixed amount.

One directly connecting booking is assessed from initial departure to final destination. C-561/20 confirms that a United sector entirely within the US can remain part of an EU261 journey when the trip began in the EU.

UK261: United departures from Britain

UK261 covers United flights beginning at UK airports. Current fixed bands are GBP 220, GBP 350 and GBP 520. Delay, cancellation, care, reimbursement and denied-boarding concepts broadly resemble the retained regime, but use UK amounts and UK procedure.

An inbound United-operated flight from the United States normally falls outside UK261 because United is neither a UK nor EU carrier. A qualifying partner operator can change the result.

For unresolved UK complaints, submit to United first. The CAA's current approved ADR participant lists do not include United, so PACT may provide a non-binding review path after the airline process.

DOT: refund rather than automatic delay payment

DOT rules govern flights to, from or within the United States for specified consumer matters. When United cancels or significantly changes a flight and the passenger rejects alternatives, an automatic refund is generally due. Current significant-change criteria include defined time shifts, different airports, extra connections and downgrade.

Payment should return to the original form, generally within seven business days for credit-card purchases or 20 calendar days for other methods. Unprovided ancillary-service fees and qualifying delayed-bag fees can also be refundable.

This system does not create a general cash amount for every controllable delay or cancellation. United's dashboard commitments can offer meals, hotel, transport or rebooking in specified controllable events, but commitments and goodwill are not the same as an EU261 award.

Denied boarding illustrates the difference

EU261 and UK261 set distance-based fixed sums for involuntary denied boarding, alongside rerouting or reimbursement and care. They generally do not require the passenger to prove airline fault in the same way as a delay claim.

DOT's oversales system uses the one-way fare, alternative arrival delay and periodically adjusted caps. A passenger who volunteers negotiates benefits instead of receiving involuntary denied-boarding compensation. United must provide a written statement of rights when the federal rule applies.

Do not quote EUR 600 for a domestic Denver-Chicago bump. Do not quote the US fare-multiple system for a Heathrow-Newark denial governed by UK261 without checking overlap and crediting rules.

Montreal Convention: a fourth, separate layer

International baggage delay, loss or damage and proven passenger-delay loss can fall under the Montreal Convention. Current ICAO-adjusted limits from 28 December 2024 include 1,519 Special Drawing Rights for baggage and 6,303 SDR for proven passenger delay damage, subject to Convention conditions.

These are liability ceilings, not automatic awards. The fixed EU261 or UK261 payment can coexist with a documented baggage claim because they compensate different harm, but duplicate recovery is not allowed.

Codeshare and United Express

The marketing code decides neither territorial status nor the respondent. Read each operated by entry. A UA code operated by Lufthansa on Newark-Frankfurt can bring EU carrier inbound coverage. An LH code operated by United remains a United operation.

United Express is a brand used for regional services flown by separate carriers. If the regional sector caused the problem, identify that legal operator. The continuous-booking rule can preserve EU261 scope, but it does not erase the need to name the carrier that performed the flight.

Future EU rules are not today's procedure

The Council gave final clearance to the 2026 passenger-rights reform, but the new rules enter into force only 12 months and 20 days after publication in the Official Journal. As at 14 August 2026, do not apply the future nine-month claim-notification period or 30-day airline response period as current law.

Existing claims continue to require the applicable national limitation period and current procedural route. The United deadline guide separates those dates.

Four classification examples

Dublin-Newark delayed four hours: EU261 can provide EUR 600 if United cannot prove extraordinary circumstances.

Heathrow-Chicago cancelled the day before: UK261 can provide rerouting or refund, care and potentially GBP 520.

Chicago-Frankfurt cancelled, passenger declines travel: DOT can require refund; EU261 fixed compensation normally does not apply to United operation.

Brussels-Newark-San Jose on one booking: EU261 can cover the journey even when the material delay arises after Newark, following C-561/20.

FAQ

Is DOT compensation the same as EU261?

No. DOT provides important refund and oversales protections but no general fixed delay award matching EUR 250-600.

Which law covers United from Heathrow?

UK261 normally governs the United-operated outbound journey from a UK airport.

Which law covers United from Dublin?

EU261 governs an eligible United-operated departure from Ireland because the journey begins in the EU.

What covers United from the US to Europe?

DOT, contract and international conventions may provide remedies. EU261 or UK261 fixed compensation normally requires a different qualifying operating carrier.

Can EU261 cover a later United flight inside the US?

Yes when that sector belongs to one directly connecting booking that began in the EU, as illustrated by C-561/20.
