First test the direction of the flight

Tunisair is a Tunisian carrier. It is not an EU or UK airline. EC261 can cover its European departures. A direct Tunisia-to-Europe flight is normally outside EC261.

Ask what failed and why it was outside normal operation

Terms such as technical, safety and aircraft change are descriptions, not legal conclusions. Request the component or event, discovery time, maintenance response and effect on the flight. A safety decision can be necessary without making the underlying cause extraordinary.

Routine wear, unexpected component failure and maintenance planning generally sit close to airline operations. Hidden manufacturing defects affecting a fleet, sabotage, bird strike or external damage can require a different assessment. Evidence decides the category.

Reasonable measures include more than repairing the same aircraft. Depending on the facts, crew, spare capacity, aircraft substitution and rerouting options may matter. EU261 does not require intolerable sacrifice, but a bare assertion that no aircraft was available is incomplete.

Technical causation can propagate through a rotation. Tunisair should connect the original defect to the claimant flight and explain intervening decisions. A problem many sectors earlier is not automatically sufficient.

Worked example

A Tunisair flight from Amsterdam arrives four hours late after an unscheduled component replacement. The EU departure is covered. The passenger requests the defect, whether it was routine, the rotation impact and available substitution before accepting an extraordinary-circumstance refusal.

EC261 normally uses great-circle distance. A protected through booking uses its final destination. Timely rerouting can sometimes reduce a fixed payment.

Extraordinary events may remove only the fixed payment. They do not erase every duty. Tunisair must prove the event, causal link and reasonable measures.

Keep baggage, refund, care and fixed payment amounts separate. Each has its own basis. Calculate the request rather than sending one unexplained total.

The EU reform approved in July 2026 is not yet applied on the checked date. Its future nine-month claim rule is not a current deadline. Nor is its 30-day reply rule. Existing law and national limitation rules still govern.

Is every safety-related fault extraordinary?

No. Safety may require delay or cancellation, but the origin of the defect still determines the legal classification.

What technical facts should Tunisair provide?

Can a bird strike be extraordinary?

It can be an external event, but Tunisair must still prove causation and reasonable measures for the particular disruption.
