Follow the passenger beyond the diversion airport

Landing safely does not end the time calculation when the aircraft is at the wrong airport. Record disembarkation, baggage delivery, offered transfer and arrival at the original destination. A passenger left to arrange a bus or taxi should preserve the route and receipt.

The reason for diversion is separate from its legal consequence. Weather, medical emergencies or airport closure may support an extraordinary defence. Fuel planning, crew decisions or ordinary technical problems can require closer examination.

Nearby airports serving the same city or region receive special treatment when transport is organised. A remote airport without onward arrangements can look more like cancellation. Geography and the actual transfer matter more than the airline label.

EC261 normally uses great-circle distance. A protected through booking uses its final destination. Timely rerouting can sometimes reduce a fixed payment.

Extraordinary events may remove only the fixed payment. They do not erase every duty. Tunisair must prove the event, causal link and reasonable measures.

The EU reform approved in July 2026 is not yet applied on the checked date. Its future nine-month claim rule is not a current deadline. Nor is its 30-day reply rule. Existing law and national limitation rules still govern.
