TUI package holiday and flight rights: airline or tour organiser?
A TUI package can create two valid claims from one disrupted flight, but they go to different legal roles. The operating airline answers UK261 or EU261 issues such as fixed compensation, rerouting and care. The tour organiser answers for performance of the package. Keeping those requests separate prevents a missed holiday service from being mistaken for automatic flight compensation.

The rules discussed are current on 9 September 2026. The July 2026 EU reform has deferred application; its future nine-month claim period is not current law.
Identify the two contracts in the booking
The package confirmation shows what the organiser promised: flights, accommodation, transfers and possibly a cruise or excursion. The e-ticket identifies the air carriage and should state the airline operating each flight. Save both documents, because one does not replace the other.
TUI Group has five airlines. TUI Airways is a UK carrier; TUI fly Germany, Belgium, Netherlands and Nordic are EU carriers. A TUI organiser may also use an outside airline. The statutory flight claim normally follows the operator, even though the customer paid TUI for the whole holiday.
The organiser remains relevant when a disruption shortens the holiday, removes an included transfer or leaves accommodation arrangements unperformed. Describe that failure by reference to the package promise rather than calling the entire holiday price “EU261 compensation”.
Apply flight rights by direction and operator
A flight departing the UK or EU can be within the corresponding passenger-rights regime regardless of the carrier's nationality. A return beginning outside those territories generally requires the matching UK or EU operating carrier. One round-trip package therefore can produce different answers in each direction.
For example, TUI Airways operating Antalya–Birmingham can bring the inbound sector within UK261. TUI fly Belgium operating Punta Cana–Brussels can bring that inbound sector within EU261. If a non-European airline operates either return, the TUI package brand does not create territorial coverage.
Once covered, fixed compensation still requires the relevant delay, cancellation or denied-boarding conditions and no successful extraordinary-circumstances defence. Direction and operator come before any promise of EUR 600 or GBP 520.
Allocate each remedy to its proper purpose
Refund or rerouting deals with unused or replacement air transport. Care provides reasonable meals, hotel accommodation and airport–hotel transfers during the wait. Fixed compensation addresses qualifying disruption on a per-passenger basis. Montreal handles proven baggage delay, loss and damage.
Package remedies concern the organiser's performance and may include an appropriate price reduction or other redress under the applicable package rules. The precise result depends on the contract, governing law and what assistance or substitute arrangements were provided. A lost excursion is not automatically added to the fixed flight award.
The same expense cannot be recovered twice. If the airline reimburses a replacement hotel night, do not claim that identical cost again from the organiser. A schedule naming the loss, amount, legal basis, recipient and payment already received keeps the file honest and understandable.
Work through a shortened-holiday example
Grace books a seven-night TUI package from Manchester to Corfu, with TUI Airways operating the flight and a TUI-arranged coach transfer. The flight is cancelled at short notice and the earliest reroute arrives 26 hours late. Grace accepts rerouting, buys reasonable meals during the wait and misses the first hotel night and transfer.
Her UK261 fixed-compensation claim, if the notice and cause tests are met, goes to TUI Airways per passenger. Her meal receipts are separate care costs against the airline. The unused hotel night and failure of the included transfer are assessed under the package contract against the organiser. Accepting the reroute does not automatically settle either other track.
If checked baggage then arrives damaged, Grace should make a prompt airport report and written Montreal claim supported by photographs and value evidence. That fourth issue is not converted into delay compensation simply because all events happened on the same holiday.
Run parallel claims without muddling evidence
Create one master chronology, then tailor two concise submissions. The airline file should lead with route, operator, original schedule, final arrival, notice, cause and flight-related expenses. The package file should quote the promised components, explain what was not supplied and show the resulting loss.

Keep acknowledgements and settlement wording. A payment from one party may reduce a duplicated loss, but it does not automatically extinguish a different legal claim against another party.

Is TUI always both organiser and operating airline?
No. The package seller may use a TUI group airline or an outside carrier. Check the operated-by field for the statutory flight claim.
Can I claim for a lost hotel night and fixed compensation?

Does accepting rerouting end my package complaint?
