How to claim compensation from TAP Air Portugal

Short answer: Gather your booking reference, flight number, route, and proof of the actual arrival time, then send TAP a written compensation claim citing EU261. If TAP refuses or ignores you, escalate to Portugal's regulator ANAC, a Julgado de Paz (peace court), or hand the file to a specialist. Compensation is EUR 250–600 depending on distance, provided the disruption was not a genuine extraordinary circumstance.
Is your TAP flight covered?
TAP is an EU carrier based in Portugal, with hubs at Lisbon (LIS) and Porto (OPO), which widens your protection in both directions:
- Departing any EU airport (Lisbon, Porto, Faro, Funchal, Ponta Delgada, or a European city TAP serves) — covered regardless of destination.
- Arriving in the EU from a third country on TAP — covered because TAP is an EU airline. This is what makes São Paulo–Lisbon, Newark–Lisbon, or Luanda–Lisbon claimable when TAP operates the flight.
- Departing the UK — EU261 does not apply; the UK's own UK261 does, with amounts of GBP 220, GBP 350, or GBP 520. See UK261 vs EU261.
One catch: the operating carrier is liable (C-532/17 Wirth). Some TAP-coded flights are flown by TAP Express or a Star Alliance codeshare partner — check the "operated by" line on your ticket, because that determines who you claim against.
What you can claim
Compensation depends on flight distance, and for a journey with a connection on a single booking it is the delay at your final destination and the distance to that final destination that govern (C-11/11 Folkerts).

Long-haul TAP routes to São Paulo, Rio, Newark, Miami, Toronto, Luanda, or Maputo sit in the EUR 600 band. TAP may lawfully cut the amount by 50% (to EUR 300 on the top band) under Article 7(2) if it rerouted you and the arrival delay at your destination stayed within set limits. Step by step: how to claim
1. Gather your evidence
Collect the booking reference (PNR), the TAP flight number (TP…), the date, the full route, and your boarding pass. The single most important item is proof of the actual arrival time at your final destination — a flight-tracker screenshot or TAP's own delay notice. Keep any email or SMS in which TAP announced the cancellation or delay, and every receipt for meals, transport, or a hotel you paid for yourself.
2. Write to TAP
Send a written claim through TAP's customer channels stating the flight, the delay length, the regulation (EU261, Articles 5 to 7), the amount you want, and your bank details. In Portugal you can also log a formal complaint in the airline's Livro de Reclamações (electronic complaints book). Set a clear response deadline and keep copies of everything you send.
(The July 2026 EU261 reform would give airlines a fixed 30-day window to respond and passengers a 9-month claim window — but that is a proposal, not yet in force, so do not rely on those numbers.)
3. Escalate if TAP refuses or goes quiet
If TAP rejects the claim, ask it to state the exact reason and prove it. A vague "operational" or "weather" line is not enough — the airline must show the cause and that it took all reasonable steps (C-549/07 Wallentin-Hermann). If you are stuck, you can:
- Refer the case to ANAC, Portugal's national enforcement body, for departures from Portugal (or the enforcement body of the EU country you departed from).
- Bring a claim through a Julgado de Paz or the CNIACC consumer arbitration scheme.

Watch the clock. Time limits to bring a claim vary by jurisdiction — Portugal, or wherever suit is brought — so there is no single universal deadline; act promptly rather than assume you have years. See TAP compensation time limits.
Strikes and extraordinary circumstances
TAP is regularly hit by strikes from its own SPAC pilots and SNPVAC cabin crew. A strike by the airline's own staff is not an extraordinary circumstance (C-28/20 Airhelp v SAS), so those cancellations are often still payable. Genuinely external events — air-traffic-control strikes, severe weather, or a bird strike — may excuse the airline. A routine technical fault normally does not (C-257/14 van der Lans).
Lost or damaged baggage is separate
Baggage sits under the Montreal Convention, not EU261. File a Property Irregularity Report (PIR) at the airport before you leave, then claim within 7 days for damage and 21 days for delay; the liability ceiling is about 1,519 SDR (since 28 December 2024) and the time bar is 2 years.
