Old SAS claim from the Chapter 11 restructuring: what can still be done?

SAS completed its Chapter 11 restructuring and emerged on 28 August 2024. Whether an older passenger claim remains collectible depends on the disruption date, exact SAS debtor, proof-of-claim history, confirmed Chapter 11 terms and any distribution or release. Do not assume that every pre-2024 claim disappeared or that EC261 entitlement guarantees payment today. A disruption arising after emergence normally begins with the current SAS claims process rather than the legacy restructuring docket.

What happened in August 2024

SAS announced that it completed its restructuring proceedings and emerged as a reorganised company on 28 August 2024. The process included US Chapter 11 and Swedish company reorganisation elements, new investment and a revised ownership structure.

Emergence did not create one simple answer for all passenger debts. Confirmed restructuring terms classify claims, establish distributions and can release obligations. The operative court documents and debtor schedules, not a general press release, decide a particular legacy claim.

Kroll maintains the SAS restructuring case site and docket. Search by debtor, proof number, creditor name and document date. Beware of unofficial sites requesting payment or banking credentials.

EC261 entitlement versus collectability

A passenger may have had a valid EC261 right because an SAS flight was cancelled or arrived late for a non-extraordinary cause. Restructuring can still alter how that pre-existing monetary claim is pursued or paid. Legal entitlement and collection procedure are separate.

Do not resubmit an old claim as if the disruption occurred yesterday without disclosing its history. SAS needs the original flight, case reference, decision, any court action and restructuring treatment. A fresh online form cannot reverse a bar date or release by itself.

Conversely, do not abandon a claim solely because the flight preceded emergence. Check whether it was scheduled, allowed, preserved, transferred or addressed through a consumer or payment mechanism.

Find the correct debtor

The SAS brand includes the central consortium and operating companies such as SAS Connect or SAS Link. The Chapter 11 debtor list and the flight's operating entity must be compared. A claim sent against the wrong company can produce misleading search results.

Use the original e-ticket, ticket stock, boarding pass, claim response and any invoice. If the operated-by name is abbreviated, compare it with SAS's corporate reporting and request historical clarification.

Codeshare partners are separate. A partner-operated flight sold under SK may never have been a claim against an SAS debtor for fixed compensation.

Proof of claim and docket records

Search the Kroll portal for the proof of claim, amendment, objection, withdrawal, transfer notice, allowance and distribution information. Save PDF copies and docket numbers. A claims agent can confirm administrative records but does not provide personal legal advice.

If the passenger used a commercial claims company, review whether the claim was assigned outright or merely represented. An assignment may make that company the creditor of record. Check termination, settlement and payment correspondence before asserting ownership.

Do not file a duplicate proof long after the bar date without legal analysis. Late filings, amendments and administrative claims have procedural standards beyond ordinary airline forms.

Claims arising after emergence

A disruption on or after 28 August 2024 is not automatically a Chapter 11 claim merely because SAS once restructured. Begin with current EC261, UK261, APPR or Montreal analysis and the current SAS claims channel.

Identify the operator and event date. Submit within the applicable deadline, preserve the case reference and escalate through current ADR or court routes if necessary. Only connect it to restructuring when documents show a relevant legacy obligation or debtor issue.

Refunds, vouchers and payment records

Legacy ticket refunds or vouchers can have treatment different from fixed compensation. Determine whether SAS, an OTA, card issuer, package organiser or insurer already repaid any amount. A chargeback or distribution must be credited against the same loss.

For an expired voucher affected by the restructuring period, preserve issue terms, extensions, communications and creditor notices. Do not assume ordinary current voucher policy controls a historical instrument.

If a distribution was issued, verify payee, currency, amount and whether uncashed funds have an administrative process. Use contact details on the official docket.

Escalation and professional review

An old cross-border claim can involve US bankruptcy orders, Swedish reorganisation law, EC261, assignment and national limitation. Seek qualified advice when value justifies it, especially if a claim was objected to, released, transferred or omitted.

Prepare a concise chronology before asking for help. Include flight date, operator, entitlement basis, amount, airline reference, proof number, docket events and payments. This avoids spending review time reconstructing basic facts.

Current status note

This page was reviewed on 26 August 2026. SAS's 28 August 2024 emergence is confirmed. Later ownership proposals or corporate transactions do not by themselves reopen or extinguish an individual legacy claim.
