Mavi Gök Airlines delayed flight: the three-hour arrival test

The essential answer: arrival delay
A delay case turns on the result at the contractual destination, not merely on a late pushback notice. EU261 and UK261 usually test the compensation threshold at arrival on the protected journey. Türkiye's amendment of 10 December 2024 extended Articles 8 and 9 remedies and monetary amounts to delays of at least three hours caused by technical or operational reasons. Weather, air-traffic restrictions and other causes should not be forced into that amendment without examining the actual event.
Practical example: arrival delay
A passenger records the door-opening time after an MGA arrival rather than relying on the runway touchdown shown by a tracking application.
One case can contain three different arrival times
The timetable shows the scheduled arrival, airport systems record touchdown, and the legal arrival time may depend on when passengers can leave after a door opens. A tracking-app image showing landing is therefore not the only evidence. Record the time zone, the wait on stand after touchdown and the time disembarkation became possible. On a protected connecting itinerary sold as one booking, the outcome at the final destination may matter more than the delay on the first sector into Antalya.
A late departure does not determine the final result
A flight can leave four hours late and recover some time, or depart almost on schedule and lose time en route. The claim should compare the scheduled and actual arrival at the contractually agreed destination. Keep the new ticket and final arrival time for every rerouting. A through booking with an onward connection calls for the full chronology, whereas a separately booked self-transfer will usually retain separate final destinations.
Direction decides which three-hour rule to examine
EU261 can be considered when the MGA flight starts in the EU, and UK261 when it starts in the United Kingdom. An MGA return from Türkiye does not become an EU or UK flight merely because it lands there. The Turkish sector may instead fall within SHY-YOLCU. For a return booking, make two case notes with separate scope, cause and arrival calculations. A single PNR does not make the legal rules identical in both directions.
Technical and operational delay under SHY-YOLCU
The amendment published on 10 December 2024 is especially important where a technical or operational cause produces an arrival delay of at least three hours. In that situation Turkish law points to the travel-choice and care provisions and provides route-dependent monetary amounts. Quote the reason MGA actually gave rather than supplying one yourself. If the airline refers to weather, ATC or security, assess the different legal basis and the assistance that may still remain available.
A flight log is stronger than a lone screenshot
Begin with the original schedule, then record the first announcement, check-in, boarding, take-off, landing and door-opening times. Link each entry to a message, departure-board photograph, airport document or carrier record. A flight-tracking screenshot can help, but its definition of time may differ from the legal one. The log also separates an MGA delay from a later operator's disruption when the journey contains more than one sector.
Meals and a hotel do not wait for the compensation decision
During a long wait, ask MGA for the care due and record the answer. If the airline fails to provide meals, accommodation or transfers despite the applicable care rules, spend reasonably and keep itemised receipts. A luxury room or alcohol is harder to justify than necessary lodging and a basic meal. Reimbursement of those expenses addresses the wait, not the three-hour arrival result itself, so it can remain due even when fixed compensation is disputed on extraordinary-circumstances grounds.
Trace the original event through the aircraft rotation
MGA may rely on an earlier incident involving the same aircraft. Ask for the rotation chronology and an explanation of how that event affected the flight in question. An external airport closure may be relevant, but the carrier should still show the reasonable steps it took. A lack of standby crew or routine fleet planning does not automatically receive the same treatment. Assess the facts, not the broad label selected in a response form.
Choose the amount only after fixing the arrival delay
Only after confirming a qualifying arrival delay should the correct statutory table be selected. EU261 uses EUR 250, EUR 400 or EUR 600 according to the legal route category and allows reductions in defined rerouting situations. SHY-YOLCU provides the equivalent of EUR 100 for a qualifying domestic route and EUR 250, EUR 400 or EUR 600 internationally, with lira conversion at the TCMB selling rate. UK261 uses sterling amounts. These tables should not be added together mechanically.
A delay claim should lead with the actual outcome
State the route, date, 4M flight number, operator and exact delay at the final destination in the first sentences. Then explain the territorial basis and the reason passengers were given. Put fixed compensation, care expenses and any reimbursement for transport not performed in separate numbered requests. Number the attached timeline, messages and receipts as well. If MGA answers only with operational delay, ask for the underlying event, its time and the measures taken.
When the airline disputes the arrival time
Request the operational door-opening data and compare it with your own material. Statements from fellow passengers, photograph metadata, a pickup message and phone location history can supplement the airport record. No single perfect document has to prove the minute, but the chronology should be consistent. If only a few minutes around the threshold are disputed, say so candidly and separate uncontested care costs from the contested lump-sum claim.
Evidence needed for verification: arrival delay
- For delay, retain the original ticket and earliest record of the event.
- In the delay analysis, build a chronology from material created during travel.
- When documenting delay, keep the carrier message that states its position.
- Link every calculation for delay to the exhibit supporting that line item.
- Before submitting delay, check that names and dates remain legible in every attachment.

FAQ — frequently asked questions
Which time determines the length of an MGA arrival delay?
Compare the scheduled arrival with the legally relevant arrival, normally when at least one aircraft door opens and passengers may leave. Touchdown time alone can understate a delay spent waiting on the stand.
Does EU261 cover a delayed MGA return flight from Antalya to the EU?
Usually not on destination alone because MGA is a non-EU operating carrier. EU261 is much more likely to govern the outbound MGA sector that departed from an EU, EEA or Swiss airport.
When does UK261 govern an MGA delay?
An MGA service leaving a UK airport can come within UK261, subject to the other statutory conditions. A Türkiye-to-UK flight operated by MGA does not gain protection solely by arriving in Britain.
How did the December 2024 Turkish amendment affect long MGA delays?
Since 10 December 2024, an MGA arrival delay of at least three hours caused by technical or operational reasons can trigger SHY-YOLCU rights linked to Articles 8 and 9. Other causes require their own assessment.
Must MGA provide care before a delay reaches three hours?
Potentially, because care thresholds depend on expected waiting time and flight distance rather than the final compensation threshold alone. Meals, communications, accommodation and hotel transport should match the actual wait.
What should a delayed passenger record at the airport?
Save departure-board images, messages, meal offers, receipts and the time disembarkation became possible. Also note every explanation announced by MGA, since cause and duration are distinct parts of the legal test.
