KM Malta Airlines diverted flight: transfer, delay and compensation

Short answer: a KM Malta Airlines flight diverted to another airport is not automatically cancelled. If the alternative airport serves the same city or region, KM should pay transport to the booked airport or another nearby destination agreed with the passenger. Fixed compensation can be due when arrival at the legally relevant destination is at least three hours late and KM cannot prove extraordinary circumstances.

Airport names can be misleading. Determine geography, ground transport and the actual destination promised on the ticket.

Same city or region

In WZ v Austrian Airlines, the Court of Justice held that diversion to an airport serving the same town, city or region does not by itself amount to cancellation. The operating carrier must, however, offer to bear the cost of transferring passengers to the booked airport or another close destination agreed with them.

If KM arranges a coach, preserve its departure and arrival times. If no transport is offered, ask in writing. A reasonable taxi, bus or train can be recoverable when self-arrangement was necessary, but keep itemised proof and choose proportionately.

The destination can be an agreed nearby point, not any location the airline selects unilaterally without transport.

Calculate arrival delay

The Court indicated that compensation can depend on arrival at the original airport or agreed nearby destination after transfer. A passenger should record:

  1. scheduled arrival at the booked airport;
  2. door-opening time at the alternative airport;
  3. time KM offered ground transport;
  4. actual arrival at the booked or agreed destination;
  5. any avoidable waiting before transfer.

Diversion outside the same region

Landing at a remote airport that does not serve the same town or region can amount to failure to reach the booked destination. KM must provide rerouting to the ticketed endpoint or offer the applicable reimbursement choice.

Do not accept a refund casually if transport is still needed. Ask for the earliest comparable route, including ground transport or another airline where appropriate. If KM fails to provide it, document contact attempts before self-booking.

An overnight diversion can create hotel, meals and transfer rights. Care continues regardless of extraordinary cause.

Checked baggage may remain on the aircraft, be delivered at the alternative airport or travel separately to the booked destination. Ask KM where collection will occur and obtain a PIR before leaving if the bag is unavailable. Ground transfer arranged for passengers does not by itself resolve a baggage delay, which uses its own written claim and receipt rules.

Passengers with reduced mobility should keep the assistance request and airport handover record. The airline's transfer solution must be usable in practice, not merely offered in a form the passenger cannot access.

Cause of the diversion

Severe destination weather, runway closure, medical emergency, security event or air-traffic instruction can be extraordinary. Technical and operational causes require separate treatment.

KM must identify the initiating event, explain why diversion was necessary and show reasonable measures to limit final delay. Even a legitimate safety diversion does not erase the duty to complete transport.

A medical emergency involving another passenger can be outside airline control, but later delay from crew positioning or unavailable transport should still be explained. Ask for a chronology rather than sensitive medical details.

Fixed amount and reduction

For an eligible disruption, current EU261 bands are EUR 250, EUR 400 and EUR 600 per passenger according to protected journey distance. A one-ticket connection can make the final destination later than Malta or the scheduled arrival airport of the diverted sector.

If KM provides rerouting and arrival stays within two, three or four hours for the applicable band, a 50 percent reduction may apply. Use actual completed transport, not an unfulfilled coach promise.

Expense evidence

Retain the ticket, boarding pass, diversion notice, airport-board photographs and any ground-transport voucher. Keep receipts showing origin, destination, time and amount. A card charge without journey detail is weaker than an itemised taxi or rail receipt.

If KM told passengers to arrange their own transfer, capture that instruction. If no representative was available, record desk closure, call attempts and screenshots. Explain why the chosen cost was reasonable at that hour and location.

Separate transfer expense, care expense and fixed compensation in the claim. A ground-transport reimbursement does not automatically settle EUR 250-600.

Submit and escalate

Use KM's Help Centre. State whether the alternative airport served the same region, where KM offered to transfer passengers, final arrival time and cause supplied. Attach a map or official airport information only when geography is genuinely disputed.

For a diversion incident arising in Malta, MCCAA may be the relevant EU261 national body after the airline complaint. Another departure location usually points to that state's body. Preserve court deadlines independently.

Is every diverted KM flight cancelled?

No. Diversion to an airport serving the same city or region is not automatically cancellation under current EU case law.

Potentially, when KM provides no effective transfer and the taxi is reasonable. Ask first when possible and keep an itemised receipt plus contact evidence.
