Hi Fly flight compensation: wet lease, charter and passenger rights

Published: 2 November 2026Updated: 2 November 2026

Hi Fly is not a normal ticket-selling scheduled airline. Its group operates passenger wet leases and full charters through Portuguese and Maltese EU carriers. EU261 or UK261 can still protect a qualifying passenger, but the flight code and commercial arrangement are critical: Hi Fly directs complaints for its own full-charter codes to its Passenger Rights Office, while a customer-airline code indicates a wet lease and a different complaint path.

Check which rules cover your flight

Enter the complete route, date, operating airline and disruption. We will check whether EU261, UK261, Turkish SHY or another passenger-rights framework may be relevant.

What happened to your flight?

Choose the situation that applies. Eligibility and currency depend on the route, operating airline, disruption and applicable law.

Choose the situation that applies to your flight:

Hi Fly describes a business-to-business model, an all-Airbus fleet spanning A320, A330 and A340 types, and operations ranging from medium-haul to very long-haul. It says neither group carrier sells tickets or runs scheduled services. A passenger therefore usually meets Hi Fly because another airline needed capacity or because an organiser chartered the aircraft.

Decode 5K/HFY and 3L/HFM before claiming

Hi Fly's current contact page identifies two group carriers and four useful codes: 5K/HFY and 3L/HFM. It says a flight using one of those codes was operated as a full charter and invites delay or cancellation complaints to passengers.rights@hifly.aero. A different code indicates a wet-lease operation, for which Hi Fly directs the passenger to the ticket-issuing airline.

Treat that published process as important evidence, not a substitute for the statutory operating-carrier test. Retain the e-ticket, boarding pass, airport display, aircraft registration, crew or safety information and any email announcing the substituted operator. Also establish whether the Portuguese or Maltese legal entity performed the flight; both are EU carriers, but the entity matters for escalation and proceedings.

Route tests for a global aircraft

Hi Fly's worldwide operating permissions do not make EU261 global. Apply geography first:

Hi Fly-operated routeEU261UK261SHY / local check
EU airport to any destinationCan apply whoever sold the seatNormally not unless the journey has a UK basisCheck destination law separately
Third country to the EU on the Portuguese or Maltese Hi Fly carrierCan apply because the actual operator is an EU carrierNormally not from that route aloneConfirm the legal entity rather than inferring it from livery
UK to an EU destination on a Hi Fly EU carrierCan apply because the operator is an EU carrierCan apply from the UK departureCoordinate overlap rather than seeking two full awards
UK to a third country outside the EUNormally not from that route aloneCan apply from the UK departureCheck destination law separately
Third country to the UK on a Hi Fly EU carrierNormally outside EU261 unless it has a separate basisCan apply because the operator is an EU carrierCheck departure law separately
Türkiye to the EU or UKCan apply to an EU arrival on a Hi Fly EU carrierCan apply to a UK arrival on a Hi Fly EU carrierSHY-YOLCU separately covers a foreign carrier departing Türkiye

The opposite direction, EU to Türkiye, is covered by EU261 from departure but not ordinarily by SHY for a foreign carrier arriving in Türkiye.

One through booking is not the same as separately purchased legs. If Hi Fly operates a downstream sector after an EU departure on a single accepted reservation, final-destination analysis may extend protection. A self-transfer cannot borrow coverage simply because the aircraft later connects in Europe.

Delay: final arrival and actual reason

The normal EU261 and UK261 compensation threshold is arrival at the protected final destination at least three hours late. Record when passengers were able to leave the aircraft, not only wheels-down time. Ask the ticket issuer for the complete itinerary and proof that connections formed one booking.

Wet-lease disruptions often generate vague explanations because the customer controls passenger communications while Hi Fly operates the aircraft. Request the flight-specific cause from both. Extraordinary circumstances require an event beyond normal airline control and reasonable measures; a generic shortage of capacity, routine technical fault or “operational reasons” should not be treated as a proven defence.

For qualifying Türkiye departures after 10 December 2024, SHY's amended delay rule addresses final arrival at least three hours late for technical or operational reasons. The reference bands are EUR 100 domestic and EUR 250, EUR 400 or EUR 600 international, paid in TRY at the TCMB selling rate on the payment date. The rule cannot be backdated.

Cancellation and denied boarding

A full-charter cancellation can involve the charter customer, organiser and Hi Fly. Establish who cancelled the air service, when the passenger learned and what alternative was offered. Under EU261 and UK261, reimbursement or rerouting is distinct from fixed compensation. Notice at least 14 days before departure normally removes the extra fixed cancellation amount, but it does not erase the transport remedy.

If the customer airline replaces Hi Fly with another operator, the flight may continue rather than be cancelled. Save revised documents because that operator can become relevant to liability and inbound scope. A package organiser cancelling the whole holiday for low demand is also not automatically a carrier cancellation under the regulations.

Denied boarding requires proof that the passenger held a confirmed reservation, met check-in deadlines and had valid documents. Separate involuntary capacity refusal from safety, health, immigration or charter-list eligibility. Note whether volunteers were sought and whether any offer was accepted voluntarily.

Separate the four money questions

EU261 fixed compensation uses EUR 250, EUR 400 and EUR 600 bands. UK261 uses GBP 220, GBP 350 and GBP 520, with a possible GBP 260 reduction for a long journey arriving three to four hours late. Distance, protection, arrival delay and rerouting determine the band; the use of an A340 or an intercontinental destination does not guarantee the maximum.

The ticket refund answers whether unused carriage must be repaid, usually through the seller or contracting carrier. Care covers reasonable meals, accommodation and transfers during disruption. Fixed compensation addresses qualifying loss of time. Proven additional delay loss on international carriage may engage the Montreal Convention, whose 6,303 SDR limit is a ceiling rather than a standard payout.

List each demand separately and disclose vouchers, organiser refunds or payments under another regulation. A passenger cannot assume that EU261, UK261 and SHY each produce a full award for one event. Itemised receipts and proof of who paid prevent double recovery while preserving valid care claims.

Full charter versus wet lease in practice

On a full charter, a tour operator, company, government or private client chooses the route and timetable and Hi Fly operates on an all-inclusive basis. Hi Fly says its own group codes identify this model for passenger complaints. The charterer may still control sales and package obligations.

On a wet lease, Hi Fly provides aircraft, crew, maintenance and insurance to a customer airline; Hi Fly says the flight uses that customer's number and the customer pays direct operating costs. The passenger normally contracts with the customer. Legal responsibility under EU261 should be checked against who performed and assumed the flight operation, rather than resolved solely by aircraft ownership.

Do not send a package-accommodation dispute to the airline's Passenger Rights Office or a fixed airline claim only to the holiday agent. One disruption can create obligations for both, but for different reasons.

Complaint sequence

For a Hi Fly-coded full charter, use the published Passenger Rights Office and provide the code, date, route, passenger names, booking evidence, final arrival, notice, cause, expenses and desired remedies. For a different code, begin with the issuing airline as Hi Fly instructs, attach proof of the Hi Fly operation and copy Hi Fly if the operator remains disputed.

EU complaints can proceed through the competent national enforcement or dispute body after the airline has considered them. A Portuguese or Maltese AOC does not make one regulator appropriate for every departure. UK261 complaints should first go to the responsible airline; after its final response or eight weeks, verify its actual ADR membership. PACT may help where no approved ADR applies but cannot order payment.

For SHY, the airline receives the first complaint. The current SHGM route can be used after ten days without an answer or an inadequate response, subject to representation and any ongoing court case. Preserve proof of submission in each system.

Check which company carried you

Enter the full route and actual operator in the flight compensation calculator, then add the four-character or two-character code from the boarding pass. The long-haul connection guide explains why a through ticket differs from a self-transfer. The result is a screen, not a guaranteed award.

FAQ

Can I buy a scheduled ticket directly from Hi Fly?

No. Hi Fly states that its two carriers do not sell tickets and do not operate scheduled flights. Passengers travel under wet-lease or full-charter arrangements.

What do 5K, HFY, 3L and HFM mean?

They are group flight identifiers published by Hi Fly. Hi Fly says those codes indicate a full charter for its complaint process; a different code indicates a wet lease.

Is Hi Fly an EU carrier on a return from outside Europe?

Its Portuguese and Maltese operators are EU carriers, so a Hi Fly-operated return into the EU can qualify. Confirm the exact entity and that another airline did not replace it.

Should I claim from Hi Fly or the airline on my ticket?

Use the code and operational evidence. Hi Fly invites complaints for its full-charter codes and directs wet-lease passengers to the ticket issuer, while statutory responsibility still needs fact-specific assessment.

Does an all-Airbus long-haul flight automatically pay EUR 600?

No. Aircraft type is irrelevant to the compensation band. Route scope, distance, event, final delay and any defence decide eligibility and amount.
