Finnair complaint escalation: Consumer Disputes Board, KKV and Traficom
After a supported complaint to Finnair fails, a private consumer with a qualifying Finland-linked dispute can seek a recommendation from the Finnish Consumer Disputes Board; Traficom supervises air passenger rights but does not award individual compensation. Business travel can fall outside the Board's private-consumer remit. Traficom indicates that business travellers may report passenger-rights issues to it, but that does not turn the authority into a compensation tribunal.
Start with a complete Finnair complaint
Before escalating, Finnair should receive the booking, operator, final-arrival calculation, cancellation notice where relevant, requested amount and evidence. Use its feedback and compensation process and save the case reference. If the ticket itself must be refunded, use the refund channel as well.
Finnair currently asks for EU261 claims within two months. The Consumer Disputes Board says a standard-compensation request should be sent to the airline within five months. File early enough to satisfy the stricter practical position.
If Finnair replies with a broad extraordinary-circumstances label, request the flight-specific event, causal link and reasonable measures. One focused review request can narrow the later dispute and show the Board what remained unresolved.
Consumer Advisory Services before the Board
The Board instructs consumers generally to contact Consumer Advisory Services after complaining to the company. The service offers guidance and mediation in Finnish and Swedish. A traveller who cannot use either language may need an interpreter rather than assuming English case handling at that stage.
Prepare the case reference, airline response, ticket and requested remedy before contacting the service. Explain whether the dispute concerns EU261 compensation, refund, care expenses or baggage because those categories rely on different facts.
The advice stage is not a substitute for court filing where a limitation deadline is close. Ask specifically whether any step affects procedural time limits; do not assume informal mediation stops them.
When the Consumer Disputes Board can help
The Board's English guidance says it can process certain EU261 cases in English. Its scope includes flight disruptions occurring in Finland. It can also examine qualifying events outside the EU where the destination is Finland, including situations in which Finland is the first EU arrival or connection covered by its rules.
An incident in another EU country normally belongs to the dispute body or authority of that country. For example, a Finnair cancellation at Paris-CDG should not automatically be filed in Finland merely because Finnair is Finnish. Read the Board's geographic examples and the European Commission's list of national enforcement bodies.
The Board handles individual private-consumer claims, including fixed compensation, certain expenses and baggage disputes within scope. It does not award emotional distress, loss of enjoyment or the cost of pursuing the case. It does not handle business trips.
Preparing the Board application
The procedure is written. Submit clear PDF documents rather than external download links. Include:
- the full Finnair booking and e-ticket;
- proof of the operating carrier;
- original and replacement schedules;
- actual final arrival evidence;
- the first claim and submission confirmation;
- every material Finnair response;
- receipts and a cost schedule; and
- authority if one passenger represents another.
Use a chronology followed by the exact requested outcome. The Board does not investigate an undefined story for the passenger. If the dispute is extraordinary circumstances, identify what Finnair claimed and why its evidence or reasoning is insufficient.
The recommendation is influential but not the same as an enforceable judgment. If Finnair does not follow it, a competent district court may be required.
ECC Finland for cross-border consumers
ECC Finland belongs to the European Consumer Centres Network. It can assist a consumer resident in another EU/EEA state with a cross-border complaint against a Finnish trader, subject to its case criteria. It is particularly useful when language, national contacts or allocation between bodies creates friction.
ECC does not replace the operating carrier test or guarantee recovery. Send the same concise evidence package and show that Finnair already had a chance to resolve the complaint.
If the passenger lives outside the EU/EEA, ECC-Net assistance may not be available. The route's enforcement body, local consumer process or court may still be relevant.
What Traficom does and does not do
Traficom is Finland's transport and communications authority. It supervises air passenger rights, provides general information and can use reports for regulatory oversight. Its page directs individual consumer disputes in Finland to the Consumer Disputes Board.
Traficom does not calculate and order a private EUR 600 payment. It also states that it may not individually answer every report. A passenger can report a systemic issue while separately pursuing compensation through Finnair, the Board or court.
This distinction matters for business travellers: Traficom may be the reporting authority, but a binding money claim may still require court action.
Events outside Finland
The competent national enforcement or dispute body often follows where the disruption occurred. A delayed departure from Germany, Spain or Italy may belong to that state's process even where Finnair operated the flight. An inbound disruption that began outside the EU requires closer attention to the destination, first EU point and the chosen body's rules.
UK261 complaints follow the UK process. The UK CAA directs passengers to an approved ADR provider where the airline participates, or to its Passenger Advice and Complaints Team in other cases. Canada APPR complaints go to the Canadian Transportation Agency after the written airline claim requirements.
Avoid simultaneous proceedings that ask different bodies to decide the same claim without disclosure. They can create jurisdiction questions or duplicate-compensation concerns.
