euroAtlantic Airways flight compensation: charter and ACMI rights
Published: Updated:
euroAtlantic Airways is a Portuguese EU airline operating scheduled and non-scheduled passenger services, including ACMI, charter and ad-hoc flying. EU261 can cover a euroAtlantic departure from the EU and its qualifying return from another continent. UK261 may cover a departure from the UK or a euroAtlantic-operated arrival into the UK. The customer airline, charterer and actual operator must still be separated before a claim is sent.

Check which rules cover your flight
Enter the complete route, date, operating airline and disruption. We will check whether EU261, UK261, Turkish SHY or another passenger-rights framework may be relevant.
What happened to your flight?
Choose the situation that applies. Eligibility and currency depend on the route, operating airline, disruption and applicable law.
Choose the situation that applies to your flight:
The airline began as Air Madeira in 1993 and adopted the euroAtlantic Airways name in 2000. Its present corporate profile describes activity across the North Atlantic, Caribbean, Central and South America, Africa, the Middle East and farther afield. That is evidence of a global operating model, not a promise that every historic destination is a current scheduled route.
Determine what kind of euroAtlantic flight it was
Five labels can appear in the documents: scheduled service, full charter, ad-hoc flight, wet lease or dry lease. Only the first four normally concern an airline operating passengers; a dry lease supplies an aircraft without the same operating package. euroAtlantic says its ACMI product includes aircraft, crew, maintenance and insurance, while a charter price can also include fuel, handling, permits and catering.
Keep the e-ticket, booking reference, airport display, boarding pass, aircraft registration and any “operated by euroAtlantic Airways” message. On an ACMI service, another airline may sell the seat and place its code on the ticket. On a full charter, a tour operator or company can control sales. The visible seller is therefore not conclusive evidence of the operating carrier.
Route coverage for a Portuguese carrier
| Passenger itinerary actually operated by euroAtlantic | EU261 screening | UK261 screening | SHY / local check |
|---|---|---|---|
| Portugal or another EU country to a non-EU destination | Can apply because departure is from the EU | Normally not unless the journey has a UK basis | Check destination law separately |
| Africa, the Caribbean or the Americas to the EU | Can apply because euroAtlantic is an EU carrier | Normally not from that route alone | Check departure law separately |
| UK airport to an EU destination | Can apply because euroAtlantic is an EU carrier | Can apply because departure is from the UK | Account for overlap rather than claiming twice |
| UK airport to a third country outside the EU | Normally not from that route alone | Can apply because departure is from the UK | Check destination law separately |
| Non-UK country to the UK | Normally only where EU261 separately protects the journey | Can apply because euroAtlantic is an EU carrier | Check departure law separately |
| EU to UK | Can apply from the EU departure | Can also apply; previous payment and overlap must be considered | No automatic SHY basis |
| Türkiye to the EU or UK | Can apply to an EU arrival because euroAtlantic is an EU carrier | Can apply to a UK arrival because euroAtlantic is an EU carrier | SHY-YOLCU can also cover a foreign carrier departing Türkiye |
For connecting journeys, identify the final destination accepted under one booking. EU261 can sometimes reach a later non-European sector when the whole trip started in the EU, but a separately purchased onward ticket does not inherit that protection. Merely changing aircraft in Lisbon does not automatically make a third-country-to-third-country journey European.
Arrival delay and extraordinary circumstances
Fixed EU261 and UK261 delay compensation generally begins at a final-arrival delay of at least three hours. Departure delay is useful evidence and can trigger care at separate thresholds, yet it is not the final compensation measurement. Record when a door opened and retain the revised itinerary if a missed connection changed arrival.
An ACMI chain can obscure the explanation: the customer airline communicates with passengers while euroAtlantic operates the aircraft. Ask for the exact cause and how it affected the flight. Exceptional weather, air traffic restrictions or a security closure may be extraordinary; a generic operational issue, normal technical defect or shortage created by the airline's planning is not automatically so. The carrier must also address reasonable measures.
If the service left Türkiye, SHY's post-10 December 2024 delay provision has a distinct test for a technical or operational cause and arrival at least three hours late. It references EUR 100 domestically or EUR 250/400/600 internationally, converted to TRY at the TCMB selling rate on payment day. Do not backdate the rule or treat the figures as an extra automatic award.
Cancellation, rerouting and denied boarding
A cancelled protected flight gives a choice between reimbursement and rerouting under EU261 or UK261. Additional fixed compensation depends on the notice date, alternative timings and reason. Notice at least 14 days before departure normally removes the fixed cancellation award, but the travel choice and appropriate care remain.
Distinguish cancellation from a change of operating airline. The charterer can replace euroAtlantic with another carrier while keeping the flight. Save both confirmations because the substitute may change the inbound legal position. A package organiser cancelling the holiday is another event and may generate package remedies rather than an airline cancellation claim.
For denied boarding, prove a confirmed reservation, timely presentation and valid documents. Capacity refusal after volunteers are sought differs from immigration, safety, health or check-in refusal. Note who made the decision and what written benefit or alternative was offered.
Compensation, fare and out-of-pocket costs
EU261 uses distance-related bands of EUR 250, EUR 400 and EUR 600. Journeys within the EU longer than 1,500 km remain in the EUR 400 category. UK261 uses GBP 220, GBP 350 and GBP 520; a long journey arriving three to four hours late can be reduced from GBP 520 to GBP 260.
Those sums do not replace reimbursement of unused carriage, rerouting or the duty to provide reasonable meals, a hotel and transfers. State each remedy separately and attach itemised receipts. If a customer airline or organiser already paid a cost, disclose it rather than claiming it again.
On appropriate international carriage, the Montreal Convention can address proven damage caused by delay. Its current passenger-delay ceiling is generally 6,303 SDR, but the passenger must prove loss and the carrier can invoke Convention defences. It is not a fixed euroAtlantic inconvenience payment and its two-year court period should not be copied to EU261 compensation without legal analysis.
ACMI, charter and package responsibility
euroAtlantic supplies aircraft capacity to clients worldwide. In a wet lease, the customer may define the commercial schedule and sell the ticket while euroAtlantic provides the aircraft and operating resources. In a full charter, the charterer chooses the mission and can package seats. Responsibility for the flight disruption depends on the legal operating role, not simply on who owns the aircraft.
The package organiser can owe assistance or a price remedy for the holiday. The ticketing airline can owe contractual duties. The operating carrier can owe EU261 or UK261 rights. One company may fulfil more than one role, but a passenger should not assume that it does. Send a remedy-by-remedy schedule.
euroAtlantic's contacts also list reservation support in Lisbon and Bissau and links concerning STP Airways. These commercial relationships do not make every STP-branded or West African flight a euroAtlantic statutory claim; inspect the particular boarding documents.
Complaint steps
euroAtlantic publishes customerservices@euroatlantic.pt for passenger complaints. Give the complete itinerary, names, ticket and booking references, actual flight code and operator, scheduled and actual arrival, notice, reason supplied, costs and desired outcomes. Copy the customer airline or organiser where it issued the ticket or still controls rerouting.
For EU261, escalation follows the competent enforcement or dispute mechanism associated with the journey. Portugal's authority may be relevant to a Portuguese departure, but another EU departure can point elsewhere. Court forum and limitation require a separate check.
For UK261, first allow the responsible airline to answer. After a final response or eight weeks, determine whether that entity participates in CAA-approved ADR. Otherwise PACT may assist but cannot impose a binding award. For a Türkiye departure, complain to the airline first; SHGM's current route can become available after ten days without a response or an inadequate response.
Check the complete booking
Enter every sector and the real operating carrier in the flight compensation calculator. Use the long-haul connection guide to distinguish a through journey from a self-transfer. Add both the customer-airline ticket and proof of euroAtlantic operation so the initial screen reflects the actual arrangement.
FAQ
Is euroAtlantic Airways the same as Air Madeira?
Air Madeira was the company's former name. It became euroAtlantic Airways in 2000; historical naming does not create a separate current airline.
Does euroAtlantic sell scheduled flights as well as charters?
Its corporate profile describes both scheduled and non-scheduled services. It also specialises in ACMI, charter and ad-hoc operations, so check the model of the actual flight.
Can EU261 cover a euroAtlantic return from Africa?
It can when euroAtlantic actually operates the arrival into the EU because it is a Portuguese EU carrier. A replacement non-EU airline can change the answer.
Who receives the complaint on a wet-lease flight?
Send it with operational evidence to the airline that meets the applicable responsibility test and involve the ticket issuer. Require a reasoned allocation rather than relying only on the flight code.
Can UK261 protect a euroAtlantic flight into the UK?
Yes, potentially. An EU carrier can satisfy the inbound-carrier condition, subject to the route, full itinerary and event requirements.
