easyJet ATC delay: test the restriction, causal chain and response

An automated message saying “air traffic restrictions” does not distinguish a Europe-wide network measure from ordinary local queueing. Ask for the record specific to the flight.
Why ATC can be extraordinary
Air navigation authorities, not easyJet, control sector capacity, separation and mandatory slots. The airline cannot lawfully ignore a restriction. Severe congestion, industrial action, emergency closure or weather-driven capacity reduction can therefore sit outside its actual control.
That does not make every minute attributed to ATC extraordinary. The carrier must separate the external restriction from its own late readiness, crew issue or aircraft rotation. If easyJet missed an allocated slot because boarding or maintenance ran late, the resulting wait may not be caused solely by ATC.
Causation for your flight
Request the timing of the ATC measure and easyJet's readiness state. A restriction from 10:00 to 11:00 cannot explain a six-hour delay without further events. If the aircraft arrived late from an earlier regulated sector, ask for registration and rotation details.
Network effects can legitimately propagate, especially during widespread closures. The evidence should still show which sector or airport caused the original delay, how it carried into your service and when recovery became possible.
Public Eurocontrol information, airport notices and authority statements can corroborate the event. Consumer flight trackers rarely show the complete regulation record.
Reasonable measures after an ATC event
easyJet need not defy an allocated slot or operate through closed airspace. It should take reasonable steps that remain possible, such as preserving readiness, seeking suitable rerouting, using another aircraft rotation, offering prompt passenger alternatives or recovering once restrictions end.
The duty is proportionate to airline resources and does not demand intolerable sacrifice. A passenger challenge should ask what options were considered, not insist that one speculative route was legally or operationally available.

ATC strike versus easyJet strike
A controller strike is external to easyJet and often extraordinary. A strike by easyJet pilots or cabin crew is part of the carrier's labour relations and generally does not receive the same treatment under C-28/20.
Airport messages can say “strike” without identifying the workers. Obtain the employer and function. Ground handling by an independent contractor requires fact-specific control analysis; it should not automatically be grouped with state air-traffic control.

Compensation if the defence fails
A covered arrival at least three hours late can produce EC261 amounts of EUR 250, EUR 400 or EUR 600, or UK261 amounts of GBP 220, GBP 350 or GBP 520. On a route above 3,500 km, a three-to-four-hour delay can be paid at half the top amount.
For cancellation, less than 14 days' notice, replacement timing and the cause must be assessed. Denied boarding uses a separate test and should not be converted into an ATC delay merely because airport capacity was constrained.

Care, refund and rerouting
ATC can remove the fixed sum while leaving substantial rights. During delay, easyJet should provide care after the distance-based waiting threshold. Overnight waiting can require hotel and transfer.
Cancellation creates reimbursement or rerouting. If the original flight remains delayed by at least five hours, a passenger can choose not to travel and request a refund. A refund selection ends the ongoing transport and care relationship, so compare it with the need to reach the destination.
Keep itemised receipts if direct assistance is unavailable. easyJet's published expense approach focuses on reasonable food and non-alcoholic drinks, three-star or equivalent accommodation and standard or shared transport.
Diversions and slot changes
ATC can direct an aircraft to another airport or restrict the booked destination. easyJet should arrange onward transfer to the booked airport or an agreed nearby place. Measure arrival after that transfer.
If a slot causes departure on the next day, retain both the original and updated schedule. A new flight number may indicate cancellation and replacement rather than mere delay; the legal classification affects refund and notice analysis.
Nearby-airport rerouting must account for ground costs. Do not accept a distant substitute without confirming how easyJet will complete the journey.
Evidence and response template
Save the exact easyJet reason, airport display, Flight Tracker, boarding pass and actual arrival. Preserve public authority or Eurocontrol notices corresponding to the date and region. Note whether the aircraft was at the gate and ready during the restriction.
Ask easyJet:
- Which ATC regulation or instruction applied?
- What was its active period and location?
- How did it affect this aircraft or rotation?
- Was the flight ready for its original slot?
- What recovery and rerouting measures were taken?
If the answer supplies a credible external record and reasonable measures, fixed compensation may not be due. Continue any refund, rerouting or expense request separately. If the answer remains generic, use the existing claim reference for a targeted review.

Does an ATC slot always remove easyJet compensation?
