Confirm the route first with the Delta compensation pillar. A European destination alone does not protect a Delta-operated flight beginning in the United States.
Delta's duty to offer rerouting
For a covered cancellation, EU261 allows the passenger to choose rerouting at the earliest opportunity under comparable transport conditions. UK261 provides a corresponding choice. An involuntarily denied passenger receives the same transport options, and a protected missed connection can require carriage to the booked final destination.
Delta should search its own services and reasonable alternatives. Air France, KLM and Virgin Atlantic may be practical transatlantic options, but partnership does not guarantee inventory. Tell the agent the carrier, date, route, cabin and final arrival of a visible alternative.
If Delta can confirm suitable transport, use it rather than purchasing independently. If Delta refuses, offers travel days later or cannot be reached within a reasonable period, preserve that failure.
Evidence before paying
Capture the cancellation notice, Delta's automatic reroute, airport queues, chat attempts and call times. Screenshot each suitable alternative with timestamp, price, cabin and availability. Record Delta's reply to a specific booking request.
A concise written message can establish the issue: “I choose rerouting at the earliest opportunity. Please confirm the listed flight arriving today. If Delta cannot provide it, please state that now.”
Also preserve:
- PNR, ticket number and complete one-ticket itinerary;
- original and proposed final arrival times;
- operating carrier of the cancelled flight;
- passenger names and accessibility needs;
- proof that a later option would not meet the transport duty;
- payment and boarding proof for the replacement actually used.
Do not rely only on a search result captured after purchase. Availability at the time Delta was asked is more persuasive.
What counts as comparable and reasonable
Comparable conditions normally begin with the purchased cabin, route purpose, passenger needs and timing. They do not guarantee the same airline, seat number or meal.
An Economy passenger should ordinarily choose Economy or the closest available cabin. If only a higher cabin is sold and urgent travel is necessary, document the absence of lower options. A Business passenger may accept Economy to arrive sooner and preserve a separate downgrade issue.
Reasonableness also includes route. A direct train from Amsterdam to Brussels after a short-haul cancellation can be more proportionate than a circuitous flight. A taxi across several countries is harder to justify if public transport is operating.
Replacement flight bought after refusal
European Commission guidance indicates that a carrier that does not fulfil its obligation to reroute at the earliest opportunity may have to reimburse the passenger's alternative flight costs. The carrier should not be allowed to convert its failure into a forced refund of only the original, cheaper ticket.
That does not produce unlimited purchasing authority. Explain why the chosen flight was the earliest reasonable solution and why Delta's offer was absent or inadequate. Deduct any refund already received for the same unused transport to avoid double recovery.
If Delta says only its own flights qualify, request the legal and factual basis. Alliance membership is not the test; the protected right is suitable rerouting under comparable conditions.
Train, coach and necessary ground transport
Rerouting does not always need to be by air. A train or coach can reasonably complete the journey, connect to a replacement airport or avoid a multi-day wait. Ask Delta to arrange or approve it before purchase where practical.
Keep the ticket, class, route and proof it was used. A rail seat comparable to the booked air cabin need not match airline branding, but premium rail selected without need can be challenged.

US-origin Delta disruption
For a Delta-operated flight leaving the United States, DOT requires refund when Delta cancels or significantly changes the flight and the passenger rejects alternatives without travelling. Delta also commits to rebooking on its own service and, in defined controllable situations, a partner with which it has a ticketing agreement.
Delta's published standard reimbursement policy says it does not reimburse alternative transportation to the final destination. A passenger who independently buys another airline or train should not assume the expense form will pay it.
Ask Delta to rebook first. If it cannot, compare accepting a cash refund, travel insurance and any contractual commitment. Do not present the self-bought US route as an automatic EU261 claim merely because it ends in Europe.
One reservation versus separate tickets
On one protected reservation, rerouting should reach the final destination shown on the ticket. If Paris-New York-Charleston is cancelled at Paris, Delta cannot satisfy the duty merely by offering New York and ignoring Charleston.
Separate tickets are different. A cancelled Delta flight does not generally make Delta responsible for an independently booked onward service. Notify that carrier immediately, seek a flexible change and check insurance.
Show the e-ticket numbers and booking structure. Similar confirmation emails do not merge two contracts.
Keep expenses in separate categories
Replacement transport, care and fixed compensation use different tests. Submit the new flight or train under rerouting. Put meals, hotel and hotel transfers under care. Calculate EUR or GBP fixed compensation separately.
Weather may defeat the fixed sum while leaving rerouting and care intact. Conversely, a valid compensation claim does not prove that an unnecessarily expensive replacement was reasonable.

Submission structure
Open with route coverage and the chosen Article 8 remedy. Provide a timeline of requests, Delta's offer or non-response, available alternatives and purchase. Attach a numbered evidence list.
Calculate the net amount carefully: reasonable replacement cost minus any refund already received for the unused original transport. Do not subtract fixed compensation. If Delta disputes price, ask which earlier comparable route it says was available and confirmable.
Submit through Delta's complaint channel and retain the case number. If a partner operated the cancelled flight, direct the statutory rerouting claim to that operator while keeping the ticket issuer involved where settlement requires it.
Worked examples
Paris-New York cancellation: Delta offers departure two days later while a same-day Air France Economy seat is available. The passenger asks Delta to book it, records refusal and buys it. EU261 can support reasonable reimbursement.
London-Amsterdam cancellation: Delta's protected itinerary cannot be restored until the following evening, but a practical same-day rail route exists. Document the request and proportional train fare under UK rerouting rights.
Atlanta-Paris cancellation: Delta operates from the United States. The passenger buys another airline without contacting Delta. EU261 ordinarily does not apply, and Delta's US expense policy excludes alternative transport.
Amsterdam-New York with a lower-cabin replacement: arriving promptly may justify accepting Economy, while the cabin loss is documented separately from transport cost.
