Brussels Airlines technical fault: when is compensation payable?
Short answer: an ordinary aircraft defect discovered during normal Brussels Airlines operations is generally not an extraordinary circumstance. A passenger who reaches the final destination at least three hours late, suffers qualifying cancellation or is denied boarding may therefore receive EUR 250-600. Exceptional events such as a hidden manufacturing defect disclosed by the manufacturer or sabotage can be treated differently. The airline must prove the specific event and reasonable measures.

The Court of Justice in Wallentin-Hermann and van der Lans rejected a broad technical-fault exemption. Unexpectedness alone does not make a defect extraordinary because aircraft operation naturally involves faults and maintenance.
Evidence to request
Ask Brussels Airlines for information sufficient to test the defence:
- component or system affected;
- time and place of detection;
- whether the issue arose during routine operation;
- manufacturer or authority instruction relied upon;
- aircraft registration and rotation chronology;
- availability of a spare aircraft, part, crew or rerouting;
- actual repair and release times;
- steps taken to limit final-arrival delay.
Passengers rarely receive a full technical log, and safety-sensitive information can be protected. The request is still useful because the airline should provide a specific factual basis rather than a one-line category.
A defect on an earlier flight
Brussels Airlines may say the aircraft became unserviceable on a previous sector and the later flight suffered knock-on delay. Request the complete sequence. Even if the initiating event was extraordinary, the carrier must connect it directly to the claimed flight and show reasonable management of the intervening period.
An aircraft rotation is not unlimited immunity. Time to source another aircraft, move passengers through partner routes or adjust the schedule belongs to the reasonable-measures assessment. Compare what was realistically available at the airport and within the network, not an imaginary limitless fleet.
Safety decision versus cause
Cancelling a flight for safety can be prudent and necessary. That does not automatically make the underlying cause extraordinary. An ordinary mechanical problem can require a perfectly justified cancellation while still producing compensation because technical risk lies within normal airline operations.
Do not argue that the airline should have flown an unsafe aircraft. Focus on whether the defect is legally extraordinary and how Brussels Airlines mitigated the disruption.
Connected journeys through BRU
On one reservation, measure arrival at the final destination. A technical delay of 90 minutes on a feeder can cause a missed African connection and an overnight arrival loss. The claim amount may then use the protected final destination rather than the short feeder distance.
Identify who operated the faulty sector. If another Lufthansa Group or Star Alliance airline performed it, address the fixed claim to that operator even when Brussels Airlines handled rebooking. The operating-carrier page explains the evidence.
Compensation and separate remedies
If EU261 applies, the standard bands are EUR 250, EUR 400 and EUR 600 per passenger. A qualifying non-EU long-haul delay between three and four hours can reduce EUR 600 to EUR 300. Cancellation notice and replacement windows may also affect payment.
Regardless of compensation, the airline owes refund or rerouting after cancellation and can owe reasonable meals, hotel and transfer while passengers wait. A technical event does not permit Brussels Airlines to replace cash reimbursement with a compulsory voucher.
If a cabin change occurs because the substitute aircraft lacks Premium Economy or enough Business seats, preserve the original fare and replacement boarding pass. Downgrade reimbursement can coexist with fixed compensation.
Practical airport record
Note the explanation given by staff, but mark it as preliminary. Photograph the departure screen, keep maintenance-related messages and save every rebooking. If passengers are asked to leave the aircraft, record boarding and disembarkation times. Preserve final door-opening time at the destination.
Other flights departing does not prove that your aircraft was serviceable. It can, however, challenge a later claim that the whole airport was closed. Use comparable operations as context and request the flight-specific evidence.
Responding to refusal
A concise answer can state that routine technical defects are inherent in normal carrier activity under van der Lans, then ask Brussels Airlines to identify any exceptional manufacturing or external event and reasonable measures. Attach final-arrival calculation and amount.

Time and submission
Use the post-travel form, identify the actual operator and put expense receipts on a separate schedule. Retain the acknowledgement.
