Brussels Airlines strike: compensation, rerouting and evidence
Short answer: a strike by Brussels Airlines' own employees is not automatically an extraordinary circumstance and can leave EUR 250-600 compensation payable. A strike by air-traffic control, airport security or another external service can qualify as extraordinary if the airline proves causation and reasonable measures. Refund or rerouting and reasonable care remain due in either case.

Do not classify the event from a headline saying “Belgian aviation strike.” Identify the employer, workers, dates, affected services and the operating airline.
Several actions can occur on the same day. Cabin crew may strike while external security personnel also reduce airport capacity, so the carrier should identify which event actually determined the cancellation or delay. A mixed cause requires a timeline rather than a single label.
Who is taking industrial action?
| Workers involved | Starting EU261 analysis |
|---|---|
| Brussels Airlines pilots or cabin crew | Own-staff action; not automatically extraordinary |
| Brussels Airlines ground employees | Own workforce; apply Airhelp v SAS reasoning |
| Independent Brussels Airport security | Potentially external |
| Belgian or foreign ATC staff | Potentially external and extraordinary |
| Handling company used by several airlines | Fact-specific control and normal-activity test |
| Partner-airline employees | Identify operator and sector affected |
The Court of Justice held in Airhelp v SAS that organised action by an airline's own staff over working conditions falls within normal management and is not extraordinary merely because employees exercise a lawful right to strike.
Notice of a strike does not decide liability
Advance announcement can give the airline time to reduce disruption. Ask when Brussels Airlines knew the scope, what schedule adjustments were made, which passengers were rerouted and why the particular final delay could not be avoided.
Reasonable measures do not require intolerable sacrifice, but they can include timely passenger communication, sensible partner rebooking, reserve planning and avoiding preventable knock-on effects. A carrier should not use the existence of action elsewhere as a blanket explanation for all cancellations that day.
External strikes
An ATC stoppage can close airspace or reduce slots regardless of airline planning. Airport-security action can make terminal operations impossible. These facts can support an extraordinary defence, but Brussels Airlines must still connect the restrictions to the flight and show mitigation.
Request the authority or airport notice, applicable time window, capacity restriction and flight-specific effect. If the airline cancelled well outside the action period, ask how the disruption propagated through the rotation.
Operating carrier on shared bookings
An SN flight may be operated by another airline whose staff are striking. Liability follows that operator. Conversely, a Lufthansa-marketed sector operated by Brussels Airlines can be affected by Brussels Airlines' workforce and should be addressed to the Belgian carrier.
The group relationship does not make every employee a Brussels Airlines employee. Record the legal employer where possible and use the codeshare guide to name the defendant.
Cancellation rights during a strike
When the flight is cancelled, passengers choose reimbursement or rerouting. Earliest rerouting is not necessarily the carrier's next own flight; a reasonable partner or other airline can be relevant. If the journey no longer serves its purpose, choose cash reimbursement and return transport where appropriate.
Fixed cancellation compensation is separate. Notice at least fourteen days in advance can remove that payment, while shorter notice requires comparison with replacement timing. An own-staff strike does not erase the fixed claim solely because the cancellation was announced.
Delays and connections through Brussels
Final-arrival delay controls compensation on one ticket. A feeder affected by industrial action can cause a missed long-haul connection and a much greater loss at destination. Keep the original and reissued itinerary.
If the feeder and onward flight were separate purchases, EU261 normally does not protect the second ticket as the final destination. Check insurance, package terms or a connection guarantee.
For qualifying travel, calculate EUR 250, EUR 400 or EUR 600 by direct distance. A long non-EU journey arriving between three and four hours late can be reduced to EUR 300.
Meals, hotel and local transport
Care duties continue during own-staff and external strikes. Brussels Airlines must provide reasonable meals and, when the wait extends overnight, accommodation and transfer. At BRU, check the boarding-pass QR code and app for assistance.
If nothing adequate is supplied, ask, preserve the response and buy proportionate alternatives. Keep itemised receipts. Do not let a ground agent's statement that “strike means force majeure” deter a care request.
Evidence checklist
- airline cancellation or delay notice;
- official union, airport, ATC or authority announcement;
- identity of affected workers and employer;
- operating carrier on each sector;
- original and replacement itinerary;
- scheduled and actual final arrival;
- alternatives available when rerouting was requested;
- hotel, food and transfer receipts.
Media reports can establish context but not necessarily the flight's causal chain. Prefer official notices and airline-specific facts.
Claim and rebuttal
State whether the action involved the carrier's own workforce or an external service. Cite Airhelp v SAS for own-staff action and request reasonable-measures evidence. If the event was external, do not deny that it may be extraordinary; instead test timing, causation and mitigation.
Submit through Brussels Airlines Customer Relations and preserve the case number. The claim-rejection guide explains Belgian mediation and evidence after a generic strike refusal.
Announced future action
Schedules and labour disputes change quickly. Verify current flight status, official notices and scope on the travel date. Do not rely on an article listing predicted strikes or fixed cancellation percentages. The legal method remains useful even when the particular action is called off.
FAQ
Does a Brussels Airlines staff strike qualify as extraordinary?
Not automatically. Court of Justice case law treats organised own-staff action over working conditions as part of normal management risk.
Is an ATC strike different?
Yes. External air-traffic action can be extraordinary, but Brussels Airlines still must prove its effect and reasonable measures.
Can I obtain a refund during strike cancellation?
Yes. Cancellation creates a choice between reimbursement and rerouting regardless of whether fixed compensation is payable.
Must the airline provide a hotel during a strike?
Yes when an overnight wait makes accommodation necessary. Care is not conditional on airline fault.
What if another airline operated my SN-coded flight?
Direct the compensation analysis to that operator and identify whose employees or external services caused its disruption.
