American Airlines strike compensation: airline staff or external action?

Covered direction remains essential
An American-operated Madrid-Miami or Heathrow-New York departure can fall under EU261 or UK261. If an internal staff strike causes qualifying delay or cancellation, fixed compensation may be due.
An American-operated Miami-Madrid or New York-Heathrow flight normally lies outside those fixed regimes. A European destination and strike cause cannot cure missing territorial scope. If Iberia or British Airways operated the inbound codeshare, re-run the test using that operator.
Internal airline strikes
European case law has treated industrial action by an airline's own staff as not automatically extraordinary, including certain organised strikes connected to employment conditions. The airline operates the business and manages labour relations, although each factual setting must be assessed.
Ask whether the workers were employed by American or by a separate provider, what services they performed and whether notice allowed mitigation. Do not assume all workers wearing branded clothing are American employees.
External strikes
ATC strikes, airport-security action and some third-party handling stoppages can lie outside American's control. Fixed compensation can be excluded if the event actually caused the disruption and reasonable measures could not avoid it.
American should still consider rerouting, alternative airports, earlier departures or available resources. A strike somewhere in the route network does not explain every flight throughout the day.
Care, reimbursement and rerouting remain important on covered departures even when the fixed amount is excluded.
Notice and cancellation
A strike-related cancellation on a covered flight triggers refund or rerouting choice and care. Fixed cancellation payment depends on notice, replacement timing and extraordinary circumstances.
If American cancelled weeks before travel after a publicly announced strike, the fourteen-day notice rule may remove fixed compensation even though other remedies remain. Preserve when the notice reached the passenger, not just when the strike was announced in media.
Evidence checklist
Keep the e-ticket, operated-by field, American's cancellation or delay message, final arrival and rerouting. Capture reliable information identifying the striking group and dates. Save care receipts.
Ask American for:
- employer of the striking workers;
- service affected;
- time the flight became impossible;
- alternatives considered;
- whether the aircraft and crew were otherwise available;
- reason final arrival remained late after action ended.
Avoid relying on social-media speculation. Official union, airport, ATC and airline notices are stronger.
Compensation amounts
Eligible EU261 claims use EUR 250, EUR 400 or EUR 600. UK261 uses GBP 220, GBP 350 or GBP 520. Delay normally needs at least three hours at final destination. A long-distance arrival between three and four hours can be reduced by half.
Payment is per eligible passenger. Actual hotel and meal costs are claimed separately with receipts.
Rerouting during industrial action
On a protected cancellation, ask for earliest rerouting under comparable conditions. This can include a partner or different route where reasonably available. An airline should not automatically limit the search to its own post-strike service days later.
Record available alternatives and any refusal before self-booking. If a train can complete a short European leg, discuss it with American and keep the response.

For external action, focus the claim on care, rerouting and any period not causally explained. Do not insist on fixed payment where official closure made operation impossible.

Knock-on delay after a strike
An earlier strike can leave aircraft and crews out of position after employees return or restrictions end. American should explain how long the original event remained causally effective and what recovery measures were available. The passage of time does not automatically make every later delay controllable, but neither does it preserve an exemption indefinitely.
Build the chronology by aircraft movement and crew assignment where reliable records exist. Keep speculation out of the claim and ask the carrier to account for the unexplained period.
