AirTanker flight compensation: civil charter passenger rights
Published: Updated:
AirTanker does operate civil passenger flights, but not every AirTanker mission is an ordinary consumer air service. UK261 can protect a qualifying journey leaving the UK or operated back to the UK by the British carrier; EU261 can protect an EU departure. Before discussing compensation, establish that the passenger held a commercial or otherwise protected booking, which organisation arranged it, and whether AirTanker actually operated the disrupted sector.

Check which rules cover your flight
Enter the complete route, date, operating airline and disruption. We will check whether EU261, UK261, Turkish SHY or another passenger-rights framework may be relevant.
What happened to your flight?
Choose the situation that applies. Eligibility and currency depend on the route, operating airline, disruption and applicable law.
Choose the situation that applies to your flight:
The distinction matters because AirTanker supports the UK Voyager programme, runs civil leasing operations and operates the South Atlantic Air Bridge. Its own description says the Air Bridge connects RAF Brize Norton with the Falkland Islands via Cape Verde and carries military personnel, contractors and civilians. A civilian on that service should not be rejected merely because the route has a government purpose, but neither should a military movement be assumed to be a standard public ticket.
Start with the passenger's legal basis for travel
Collect the booking authority, joining instructions, e-ticket if one exists, passenger manifest confirmation, invoice and correspondence from the employer, government department, tour organiser or customer airline. Ask whether the seat was sold to the passenger, provided under employment or public-service arrangements, or carried under a private charter agreement. Those facts can affect who owes contractual remedies even before territorial regulations are considered.
AirTanker holds a civil AOC and describes main bases at RAF Brize Norton and Manchester. It also operates Airbus A330-200 aircraft for customer airlines under wet or damp leases. The aircraft may carry the customer's branding or flight number. An AirTanker crew and registration can be stronger evidence of actual operation than the name on the sales confirmation.
UK261, EU261 and special destinations
| AirTanker passenger movement | Initial passenger-rights screen |
|---|---|
| Qualifying flight from a UK airport | UK261 can apply regardless of the destination, subject to the nature of the service and event |
| AirTanker-operated flight from a third country to the UK | UK261 can apply because AirTanker is a UK carrier |
| Commercial departure from an EU airport | EU261 can apply regardless of AirTanker's UK nationality |
| AirTanker flight from a third country into the EU | EU261 normally does not apply on that sector alone; UK261 may still require journey-level analysis for a UK carrier |
| AirTanker flight for another airline | Identify who qualifies as the operating carrier and keep wet-lease evidence |
| South Atlantic Air Bridge to or from the Falkland Islands | A UK departure can engage UK261, but the passenger status, itinerary and any service-specific rules must be checked |
The Falkland Islands are a British Overseas Territory, not part of the United Kingdom. Calling the destination “British” does not turn the inbound sector into a domestic UK flight. The outbound journey begins at a UK airport; the return requires the UK-carrier test and a review of the complete itinerary. A Cape Verde stop does not, by itself, split or extend the legal journey.
If an AirTanker civil operation departs Türkiye, SHY-YOLCU may cover the foreign airline. Domestic and international reference amounts are respectively EUR 100 and EUR 250/400/600, converted to TRY at the TCMB selling rate on payment day. Military work or passenger nationality does not activate SHY; the service and geography still matter.
What counts as a compensable disruption?
For a protected EU261 or UK261 delay, the usual fixed-payment threshold is arrival at the final destination at least three hours late. Determine the ticketed destination and whether intermediate sectors formed one accepted journey. A technical stop on a through Air Bridge service is different from a self-transfer where the passenger separately arranged the next flight.
Extraordinary circumstances can remove fixed compensation only when the carrier proves the relevant event and reasonable measures. Government instructions, airspace restrictions, exceptional weather or security issues may be significant on specialised operations, but their existence must be connected to the particular delay. “Operational requirement” is not a complete legal explanation. Care and transport remedies can survive even when fixed compensation does not.
Cancellation rights require the exact notice date and alternative offered. On a protected public-facing service, reimbursement and rerouting are distinct from additional compensation. Where transport was arranged by an employer or government customer and the individual did not buy the fare, repayment may belong to the payer while the passenger can still have personal statutory rights; documentation is essential.
Denied boarding also needs context. Capacity refusal on a commercial passenger booking is different from a security clearance, deployment change, documentation decision or instruction by the chartering organisation. Preserve the stated reason, reporting time and any request for volunteers.
Fixed awards, care and proven loss
UK261 provides GBP 220, GBP 350 or GBP 520 according to distance, with a possible reduction to GBP 260 when a qualifying journey over 3,500 km arrives between three and four hours late. EU261 uses EUR 250, EUR 400 and EUR 600. These bands depend on the protected journey and are not guaranteed by the aircraft type, flight duration or passenger's civilian status.
Reimbursement restores an unused fare to the person entitled to it. Care covers reasonable meals, accommodation and transfers during the wait. On a customer-airline lease, the customer may organise those services at the airport; keep receipts and correspondence showing what AirTanker or the contracting organisation provided. Do not seek repayment twice from the airline and employer.
The Montreal Convention can be relevant to documented loss caused by delay in qualifying international carriage. Since 28 December 2024, the passenger-delay liability limit is generally 6,303 SDR. It caps proven loss; it is not a fixed AirTanker delay award and does not replace the evidence, defences, jurisdiction or two-year Convention time analysis.
Leasing changes the visible brand
AirTanker states that its leasing business supplies wet leases, including aircraft, flight crew and cabin crew, and damp leases, in which the customer provides some cabin staffing. Passenger-facing services can therefore display another airline's flight code, livery and booking channel even when AirTanker supplies the operating aircraft and pilots.
Ask for the replacement-aircraft notification and photograph the registration if it is safe to do so. Retain the customer airline's ticket because it shows the accepted itinerary and contractual carrier. Statutory operating-carrier responsibility can require a more detailed assessment than simply choosing whichever company appears most prominently.
Package travel is less typical than capacity leasing in AirTanker's published model, but the same role distinction applies if a tour organiser is involved. The organiser handles package obligations; the operating carrier handles the relevant flight duties. AirTanker military support, the public authority arranging transport and a commercial customer airline are not interchangeable defendants.
How to raise the complaint
Write first to the passenger-facing contact stated in the travel documents and to the customer airline when it sold the itinerary. If evidence identifies AirTanker as the relevant operator, use AirTanker's official contact route and require the parties to clarify responsibility. Provide the full itinerary, passenger status, booking authority, actual aircraft/operator, notice, arrival time, reason given, expenses and any replacement transport.
Separate the requests: fixed UK261 or EU261 compensation, reimbursement, rerouting, care costs, baggage and additional proven loss. Say who paid each amount. A complaint framed only as “refund my AirTanker flight” may fail where the fare was paid centrally or the service was supplied to another airline.
For a UK261 dispute, allow the carrier to answer before escalation. After a final response or eight weeks, verify whether the responsible carrier participates in CAA-approved ADR; if not, PACT may be relevant but cannot impose a binding result. Court limitation is generally six years in England and Wales and five in Scotland, while forum and passenger standing depend on the facts. For EU departures, use the competent national enforcement or dispute route instead of importing the UK timetable.
Check the flight before choosing a remedy
Use the flight compensation calculator only after entering the true airports, final destination and operating airline. Add a note explaining whether the journey was the South Atlantic Air Bridge, another civil charter or an AirTanker wet lease for a customer. The UK261 and EU261 guide can help with geography, but specialised passenger status still needs individual review.
FAQ
Does AirTanker carry civilian passengers?
Yes. AirTanker says civilians travel on the South Atlantic Air Bridge, and its civil leasing business operates passenger aircraft for customer airlines. That does not make every military mission a consumer flight.
Is the Falkland Islands route a domestic UK flight?
No. The Falkland Islands are a British Overseas Territory, not part of the UK. UK261 may still apply because of the UK departure and AirTanker's UK-carrier status.
Who receives a fare refund if my employer paid?
That depends on the booking and contract. The payer may be entitled to the fare, while some statutory passenger rights attach personally. Submit the payment and booking evidence.
Can I claim when the ticket showed another airline?
Potentially. AirTanker performs wet- and damp-lease services. Identify the entity that operated and controlled the disrupted flight and involve the ticketing airline rather than relying on the livery alone.
Does an operational or government reason automatically defeat compensation?
No. The specific circumstance, its connection to the flight and reasonable measures must be assessed. Specialised operations can produce valid defences, but a generic label is not proof.
