Air Serbia strike: compensation, care and rerouting

Short answer: a strike by Air Serbia's own employees is not automatically extraordinary under EU261; Court of Justice authority treats organised and spontaneous staff action arising from normal labour relations as potentially within airline control. An external strike by air-traffic control, airport security or another independent workforce is more likely to support an extraordinary-circumstances defence. The carrier must still prove causation and reasonable measures.

A contractor label is not conclusive. Examine whether the work is integral to Air Serbia operations, whether the carrier could influence staffing and whether alternative handling was reasonably available.

Internal airline strike under EU law

In Krüsemann, the Court of Justice considered a spontaneous staff absence following airline restructuring and rejected automatic extraordinary status. In Airhelp v SAS, the Court held that a lawful strike organised by the carrier's employees over employment conditions was inherent in normal activity and within effective control.

That does not guarantee payment after every staff dispute. Air Serbia can still contest coverage, final delay, notice or another independent cause. It can also show that specific consequences were unavoidable despite reasonable measures. The central point is that “strike” alone does not end the EU261 analysis.

External strike and causal link

An ATC stoppage may force capacity restrictions or airspace closure. Airport staff action may prevent security screening or baggage acceptance. These can be external, but Air Serbia should identify the relevant authority notice, times, airports and effect on its flight.

If the strike ended at noon and a late-evening service was cancelled, ask how the carrier recovered its aircraft and crew. A continuing knock-on effect can be genuine, yet the airline must show why rerouting, rotation changes or another reasonable measure did not limit it.

Comparing other flights can raise useful questions but is not decisive. Different slots, aircraft positions and crew duties can explain different outcomes.

Direction and legal system

EU261 covers an Air Serbia-operated departure from an EU/EEA airport. UK261 covers departure from London or another UK airport. A Belgrade-origin service ordinarily uses Serbian passenger legislation, and Canadian APPR applies to Toronto travel.

APPR classifies labour disruptions differently according to control and the facts. Current Canadian guidance lists labour issues among situations that can be outside airline control, but a carrier's own conduct and tariff must still be reviewed. Avoid transferring an EU employee-strike judgment directly into the Canadian system.

Cancellation and delay remedies

After a covered strike cancellation, choose between:

  • refund of the unused ticket;
  • rerouting at the earliest reasonable opportunity;
  • later rerouting where the applicable law provides it.

Fixed compensation depends on strike classification, notice and replacement timing. A strike announced publicly months earlier does not necessarily prove that the individual passenger received valid cancellation notice at least 14 days before departure.

For delay, record final arrival at the last destination on one protected booking. A missed Belgrade connection can make the final delay much longer than the initial strike-related wait.

Care remains practical and separate

External industrial action can remove fixed compensation without removing qualifying care under EU261, UK261 or Serbian protections. Air Serbia should provide proportionate food and communication and, when required, accommodation with transfers.

Ask at the airport and through recorded customer channels. If the response is ineffective, keep itemised receipts for reasonable needs. A passenger should mitigate cost while not accepting unsafe or inaccessible accommodation.

Canadian standards of treatment depend more directly on the control category. State the APPR basis separately for a Toronto journey.

Evidence to retain

Save:

  1. the original and replacement itinerary;
  2. notice of strike and Air Serbia messages;
  3. identity or employer of the striking workforce;
  4. airport or ATC operational notices where available;
  5. actual final arrival;
  6. alternative flights requested and offered;
  7. meal, hotel and transport receipts;
  8. Air Serbia claim and reply.

Ask Air Serbia whether the cancellation resulted directly from the work stoppage, a crew-duty issue after it, aircraft displacement or a commercial recovery decision. Each causal link needs evidence.

Wet lease and codeshare complications

If a JU-coded flight is operated by a codeshare partner, the partner's employees and claim process can control the analysis. For a designated Air Serbia wet lease, partner crew may operate under the published JU arrangement; determine which undertaking controlled the service and labour response.

Do not file duplicate fixed claims against both carriers. Attach the operated-by line and ask Air Serbia to confirm responsibility if the arrangement is unclear.

Responding to a strike refusal

A focused reply should state the governing regime, identify the workforce, cite the relevant internal or external classification and request the causal and mitigation evidence. Keep ticket refund, care and fixed compensation in distinct sections.

For Serbian procedure, complain within 90 days and allow the 60-day complete-file response stage. CAD oversight does not itself create a private payment order, so preserve limitation and court options.

FAQ

Does an Air Serbia staff strike remove EU261 compensation?

Not automatically. EU case law treats airline-employee action arising from normal labour relations as potentially inherent in carrier activity and within control.

Is an ATC strike extraordinary?

It can be because air-traffic controllers are generally external to the airline. Air Serbia must still prove the restriction affected the flight and show reasonable measures.

Does early media coverage count as cancellation notice?

No. Public reports of possible action are not necessarily individual notice that the passenger's flight was cancelled with a compliant replacement.

Are meals and hotel due during an external strike?

Under qualifying EU261, UK261 and Serbian conditions, care can remain due despite an external cause. Canadian APPR care depends on its own control classification.

Who is responsible when wet-lease crew strike?

Examine the published operational arrangement, employer and carrier controlling the JU service. Aircraft branding alone does not allocate passenger liability.
