Air France overseas France claims: territory, distance and route
Short answer: do not assume that every very long Air France flight between mainland France and an overseas French territory pays EUR 600. Several French outermost regions are treated as EU territory for passenger rights, making a long journey an intra-EU flight that can fall in the EUR 400 band. Other territories require a third-country analysis. Verify the territory’s status, operator and complete itinerary.

Geography is not the legal test
The European Commission’s passenger-rights guidance treats the EU as including French overseas areas such as Guadeloupe, French Guiana, Martinique, Mayotte, Réunion and Saint-Martin. Flights between those territories and mainland France can therefore be intra-EU for EU261 despite crossing thousands of kilometres.
Other French territories, including French Polynesia, New Caledonia, Wallis and Futuna and Saint Pierre and Miquelon, require a third-country analysis. Official materials have not always used identical lists for Saint Barthélemy, so verify its current status and the specific EU261 guidance rather than relying on a generic “French territory” label.
Why EUR 400 can apply to a very long flight
EU261’s fixed bands include EUR 400 for intra-EU flights over 1,500 km. If both endpoints are within territory covered by the EU rules, distance alone does not move the journey to the “other flight over 3,500 km” EUR 600 category.

This distinction concerns fixed delay, cancellation or denied-boarding compensation. A cabin downgrade has its own Article 10 calculation, which expressly treats certain mainland-to-overseas journeys differently.
Examples requiring classification
Mainland France to Guadeloupe or Martinique
These are commonly treated as intra-EU passenger-rights journeys. An eligible Air France disruption can therefore begin at EUR 400 rather than EUR 600, despite long distance.
Mainland France to Réunion or Mayotte
These outermost regions are part of the EU territorial framework for current passenger guidance. Verify the exact itinerary and operator, especially where another carrier or regional connection is involved.
Mainland France to French Polynesia or New Caledonia
Treat the destination as outside the EU for the initial EU261 analysis. Departure from Paris remains covered. On the return, Air France’s EU-carrier status can bring an Air France-operated flight into scope when arriving in EU territory.
Connection through a third country
If one ticket routes through a non-EU airport or uses a partner, map every operator and final destination. A stop does not automatically change the endpoints, but the operating-carrier structure can affect inbound coverage.
Final destination and separate tickets
On one reservation, use the last ticketed destination affected by the disruption. A feeder from another European city through Paris to an overseas region can be one intra-EU journey where the territory is within EU scope.
Separate tickets break that protection more easily. If a passenger buys Brussels–Paris independently and Paris–Papeete on another ticket, the first carrier is not automatically responsible for the second journey after a missed transfer.
Keep the full e-ticket, because airport pairs alone may hide a surface transfer, separate coupon or partner operation.
Delay, cancellation and cause
Eligible delay compensation usually requires final arrival at least three hours late. A long-haul aircraft can recover time, so departure delay is not enough. Record door-opening time at the true final destination and any replacement arrival.
Cancellation payment depends on notice and alternative timings. Air France must still offer refund or rerouting even when at least 14 days’ notice removes fixed compensation.
Tropical storms, volcanic activity, airport closure or ATC restriction can be extraordinary if Air France proves the causal link and reasonable measures. Ordinary technical faults or normal aircraft rotation remain part of airline operations unless a specific external event changes the analysis.
Care in remote destinations
Meals, hotel and transfers can remain due during qualifying waits, including extraordinary events. Availability may be constrained on an island or during a regional emergency. Record attempts to obtain Air France assistance, the alternatives available and why the cost was reasonable.
If rerouting uses a different airport, Air France should address transfer to the booked airport or another nearby destination agreed with the passenger. A replacement involving an overnight stop must include practical baggage and accommodation instructions.
Do not choose a full refund if the passenger still wants rerouting. The remedy selection changes Air France’s remaining transport duty.
Operating carrier and regional sectors
Air France may sell an itinerary containing another airline’s domestic or regional service. Check “operated by” for each flight. A French brand, AF code or common ticket does not make Air France the operator of every sector.
For wet lease, EU guidance focuses on which airline retains operational responsibility. Aircraft registration and paint are only evidence. Use disruption notices and the e-ticket to identify the responsible carrier.

Claim calculation
State the territory analysis explicitly:
The booked journey was between [origin] and [final destination]. Both endpoints are within the EU passenger-rights territorial scope, so the intra-EU over-1,500 km band of EUR 400 applies. Final arrival was [delay].
Or, for a third-country territory:
The flight departed EU territory for [destination] and exceeded 3,500 km. I request EUR 600 per eligible passenger, subject to the documented final delay and cause.
Attach the full itinerary, operator, arrival and territory source. Separate hotel, ticket and baggage amounts.
Conflicting or changing territory information
Official summaries can simplify constitutional status and have differed over time. If two current official sources classify a territory differently, do not hide the conflict. Quote the specific EU261 interpretive guidance, treaty status and date, then seek legal clarification before litigation.
This caution is particularly appropriate for territories whose EU status has changed. The purpose is an accurate claim, not forcing every overseas journey into a preferred amount.

Is Paris–Martinique always a EUR 600 Air France claim?
No. Martinique is within the EU passenger-rights territorial scope, so an eligible intra-EU journey over 1,500 km generally begins at EUR 400.
Does EU261 apply to Réunion and Mayotte?
Current European Commission passenger guidance includes both within EU scope. Verify the actual operator, itinerary and event.
What about French Polynesia?
It is treated as outside EU territory for this analysis. A Paris departure is covered, while an Air France-operated return into the EU uses the EU-carrier inbound rule.
Can an overseas weather event remove care?
No automatic removal follows. Proven extraordinary weather may defeat fixed compensation, but qualifying care and refund or rerouting remain separate.
Why can downgrade percentage differ from the fixed band?
Downgrade uses Article 10 and the price of the affected sector, with categories expressly addressing certain overseas routes. It is a different remedy from EUR 250–600 compensation.
