Air France overbooking: involuntary denied boarding rights
Short answer: if Air France refuses boarding against your will even though you have a confirmed reservation, valid travel documents and presented yourself on time, EU261 can require immediate compensation of EUR 250, EUR 400 or EUR 600 plus your choice of refund or rerouting and care. Do not confuse an involuntary refusal with accepting a voucher to volunteer, or with a refusal based on health, safety, security or inadequate documents.

Protect your position at the gate
Ask the Air France agent to state the reason in writing. Preserve:
- booking confirmation and e-ticket;
- boarding pass or check-in confirmation;
- passport, visa and entry-document evidence;
- the time you reached check-in and the gate;
- any request for volunteers and the terms offered;
- the involuntary denied-boarding notice;
- the replacement itinerary and actual final arrival;
- meal, hotel and transfer receipts.
Do not write that you volunteered if Air France selected you. If the agent asks for your signature, read whether it records voluntary surrender, compensation receipt or only acknowledgement of information.
When EU261 denied boarding applies
The core conditions are a confirmed reservation and timely presentation for check-in and boarding, unless Air France had reasonable grounds to refuse carriage. Overbooking is the familiar example, but EU protection is not limited to selling too many seats.
In Finnair v Lassooy (C-22/11), the Court of Justice confirmed that denied boarding can include operational reasons beyond overbooking. An airline cannot necessarily exclude compensation because it reorganised later flights after an earlier extraordinary event.
Possible qualifying situations include an aircraft substitution with fewer seats, weight restrictions applied through passenger selection, or operational reallocation. The precise facts remain important.
Reasonable grounds for refusal
EU261 does not require compensation where boarding is reasonably denied for reasons such as health, safety, security or inadequate travel documentation. Examples can include:
- missing visa or passport validity;
- a binding security instruction;
- conduct creating a genuine safety risk;
- late arrival after the published gate-closing time;
- inability to carry a passenger safely under applicable medical requirements.
The airline's label is not conclusive. Ask which document, rule or conduct supported the decision. If an automated travel-document system was wrong and your documents were valid, retain official entry requirements for the travel date.
Volunteers and negotiated benefits
Before denying boarding involuntarily, the carrier should call for volunteers willing to surrender reservations in exchange for agreed benefits. A volunteer negotiates a contract: cash or voucher, hotel, meals, confirmed replacement timing and any upgrade or lounge access should be written down.
The statutory EUR 250-600 payment for involuntary denial does not automatically apply to a person who freely volunteers. Do not accept an unclear gate offer under pressure. Ask whether you remain confirmed on the original flight until the agreement is completed.
If too few passengers volunteer and Air France selects you, request written confirmation that the refusal is involuntary.
Immediate compensation amounts
The normal Article 7 amounts are:
| Journey category | Standard payment |
|---|---|
| up to 1,500 km | EUR 250 |
| intra-EU over 1,500 km, or another route of 1,500-3,500 km | EUR 400 |
| another route over 3,500 km | EUR 600 |
Air France passenger-rights information states that cash compensation should be paid at the airport, with a higher non-refundable travel voucher possible if the passenger chooses it. Rerouting that limits arrival delay within statutory thresholds may permit a 50% reduction.
Compensation belongs to each qualifying passenger, not once per reservation. An infant without a paid seat or a passenger travelling on a special ticket can require a fact-specific assessment, but an award ticket is not excluded merely because miles paid for it.
Refund or rerouting choice
An involuntarily bumped passenger also receives the Article 8 choice:
- reimbursement of the unused ticket, and where relevant a return to the first departure point;
- rerouting to the final destination at the earliest opportunity;
- later rerouting at the passenger's convenience, subject to seat availability.
If you still need to travel, request a confirmed route rather than accepting a refund by default. Air France may need to consider another carrier where its own next service is materially later. Keep screenshots of practical alternatives.
On a connected ticket, rerouting should cover the entire disrupted journey to the final destination, not merely the sector where boarding was refused.
Care while waiting
Air France should provide meals and refreshments in relation to the wait, communication, and hotel plus transfer where an overnight stay becomes necessary. These rights accompany involuntary denied boarding.
If vouchers are unavailable or unusable, purchase reasonable items and keep receipts. Explain why a cost was necessary, especially at CDG where a late replacement may require transport to accommodation outside airport grounds.
Gate downgrades are different
Air France may offer carriage in a lower cabin instead of removing you from the flight. If you travel in that lower cabin, the issue is usually downgrade reimbursement of 30%, 50% or 75% for the affected flight, not denied boarding from the journey.
If you reject the lower cabin and the airline refuses carriage despite your confirmed premium reservation, document exactly what was offered and why. Multiple remedies should not compensate the same loss twice, but fixed disruption compensation and a cabin refund can coexist when their separate conditions are met.
Missed connection because Air France predicted failure
An airline may remove a passenger from an onward segment because it expects the inbound delay will make the connection impossible. If you actually arrive at the gate in time and are refused, preserve gate timing and staff statements. If rerouting produces a long final delay, both missed-connection and denied-boarding principles may require examination.
Do not rely only on the label printed in the app. Request the operational reason and the final status recorded for each coupon.
Codeshare bookings
The carrier that actually refused boarding normally handles the EU261 claim. An AF flight number can be operated by KLM, Delta, HOP or another airline. Check "operated by" on the ticket and boarding pass.
The seller or marketing carrier may still handle a ticket refund or agency issue. The Air France operating-carrier guide separates those roles.
Submit the claim
State that you held a confirmed reservation, arrived by the required time with valid documents and did not volunteer. Attach the written reason and replacement itinerary. Request the fixed amount, the selected Article 8 remedy and itemised care expenses separately.
If Air France alleges document failure, quote the official rule that applied on the travel date and provide copies safely. Redact unrelated personal data but retain originals.

FAQ
Does Air France have to ask for volunteers first?
Yes. The carrier should seek passengers willing to surrender reservations for agreed benefits before selecting people for involuntary denied boarding.
Is a gate voucher the same as statutory compensation?
Not necessarily. A volunteer's voucher is negotiated, while an involuntarily refused passenger has statutory rights. Air France also offers higher non-refundable vouchers as an alternative to cash compensation by agreement.
Can Air France refuse me for a missing visa?
Reasonable refusal for inadequate travel documents can fall outside compensated denied boarding. Challenge the decision with official requirements if your documents were actually valid.
Does an aircraft change with fewer seats count?
It can. Denied boarding protection extends beyond classic commercial overbooking to certain operational refusals, subject to the facts and reasonable-ground exceptions.
Can I claim for every family member?
Each qualifying passenger has an individual compensation entitlement. Keep tickets and boarding evidence for every person on the reservation.
