Air France escalation in France: DGAC, mediation and court

Short answer: complain to Air France first. If the answer is negative or absent, DGAC, Médiation Tourisme et Voyage and a court perform different roles. This guide reflects French official information checked on 13 August 2026. It does not assume France is the proper forum merely because Air France is French.

Step one is a complete Air France complaint

Before external escalation, submit a written claim to Air France and preserve:

  • the submitted form or letter;
  • acknowledgement and reference number;
  • e-ticket, booking and operating-carrier evidence;
  • boarding passes and final-arrival records;
  • cancellation notice and alternative itinerary;
  • itemised expense schedule and receipts;
  • the airline’s full answer.

Air France says an existing case should be tracked or modified rather than duplicated. If the refusal is vague, request the exact cause and reasonable measures under that reference. External bodies need a coherent record of what Air France was asked to decide.

They are not interchangeable. A DGAC report can help regulatory oversight but is independent of collecting an individual refund or compensation award. Mediation is not the same as an administrative complaint. Court proceedings require jurisdiction, evidence and attention to costs and time limits.

When DGAC is competent

French transport-ministry guidance states that DGAC is the designated enforcement body for:

  • flights departing from an airport in France, regardless of carrier or destination;
  • flights arriving in France from a third country when operated by an EU, EEA or Swiss carrier.

For a disruption departing another EU state, that state’s designated body is generally the relevant regulator. An Air France-operated Rome–Paris flight therefore should not be sent to DGAC solely because the airline is French.

DGAC’s May 2026 guidance says passengers should first complain to the carrier and wait at least two months for its response before reporting the dispute. DGAC uses reports to monitor compliance and can impose administrative fines for established breaches. It expressly separates that mission from resolution of individual payment requests.

Médiation Tourisme et Voyage

MTV provides free consumer mediation for disputes with participating travel businesses. Its current public process asks the consumer to:

  1. make a written complaint to the professional;
  2. receive a negative answer or wait 60 days without response;
  3. verify that the business is a member and the dispute is eligible;
  4. submit the file before entering court proceedings.

Check Air France’s current membership and the mediator’s full admissibility rules on the filing date. Preserve the original complaint because it defines the scope of the dispute. Add a simple schedule of amounts rather than hundreds of unsorted screenshots.

Mediation can be practical for a documented consumer claim where Air France and the passenger disagree on cause, rerouting cost or payment. The mediator proposes a solution; that is different from immediate enforcement through a judgment.

Court proceedings

A court can decide the individual debt, but the correct court is not selected by airline nationality alone. Jurisdiction can depend on departure, arrival, place of contractual performance, defendant and consumer rules. Applicable law also affects limitation.

Before filing, identify:

  • defendant’s correct legal entity;
  • operating carrier and relevant flight;
  • legal basis for each amount;
  • court jurisdiction and service requirements;
  • limitation or prescription date;
  • recoverable interest and procedural costs.

Do not call every expense “EU261 compensation.” Fixed payment, ticket refund, care reimbursement, downgrade and Montreal Convention damages should appear as separate heads. A clear chronology and indexed exhibits make a small claim easier to assess.

Since February 2026, French procedural changes affecting prior amicable resolution must be checked for the specific dispute and court. Do not rely on an old article saying mediation is always optional or on a broad statement that every aviation case must follow exactly the same pre-court path. Verify current procedural requirements when filing.

Which route for common Air France scenarios?

Paris departure cancelled

Complain to Air France. After the relevant wait, a DGAC report can address regulatory compliance. Eligible consumers can consider MTV for an amicable personal solution, while a competent court remains the route for a binding award.

Flight from Germany to Paris

The German enforcement body is generally linked to the departure event. French mediation or court jurisdiction may still require separate analysis based on the contract and consumer position; do not use DGAC as the automatic regulator.

Air France-operated New York to Paris

EU261 can apply because Air France is an EU carrier and DGAC competence can arise for arrival in France from a third country. US DOT refund and complaint rights may also be relevant. Recovering twice for the same inconvenience is not permitted.

AF code operated by Delta

Identify Delta as operating carrier and test the US-to-EU direction. Air France’s French establishment does not extend EU261 to a third-country carrier’s inbound sector merely because AF marketed it.

Build an escalation file

Use a one-page cover note containing:

Deadlines still matter during escalation

The mediator’s 60-day condition and DGAC’s two-month guidance are procedural waiting points, not universal limitation periods. A court deadline can continue running while customer service or regulation proceeds.

French law can provide a five-year general civil period where applicable, but forum and governing law must be established. Montreal Convention court action uses a two-year extinguishing period. The future nine-month EU claim rule was not yet applicable on 13 August 2026.

Review the deadline analysis before waiting for an institution. If a date is near, obtain advice on preserving the claim.

Can DGAC order Air France to pay my EUR 600?

DGAC supervises general compliance and can sanction breaches, but its official guidance says this action is independent of resolving individual compensation and refund requests.
