Air Austral flight compensation for delay or cancellation
Published:
An Air Austral delay or cancellation does not produce one all-purpose payment. As the law stands on 9 September 2026, a passenger may have a claim for fixed EU261 compensation, a choice between refund and rerouting, a right to care, and a separate claim for proven losses. Each has different conditions. Start with the direction of travel and the airline shown as “operated by”, not simply the UU code or the distance on a map.

Check whether EU261 covers the disrupted flight
EU261 covers a flight leaving an EU airport regardless of the operating airline. It also covers a flight arriving in the EU from a genuine third country when an EU airline operates it. Air Austral is a French EU carrier. Réunion and Mayotte are EU outermost regions, so Paris–Saint-Denis, Saint-Denis–Paris and routes involving Dzaoudzi are not ordinary Europe-to-third-country journeys.
That geography matters. An Air Austral-operated Mauritius–Réunion service can fall within the arrival limb because Air Austral is an EU carrier and Réunion is EU territory. Mauritius, Madagascar, Comoros and Seychelles remain third countries. If EWA Air, Air France or another partner actually operates a sector, apply the rule to that operator and direction. A UU marketing number cannot settle the question.
For a through booking, the relevant delay is normally measured at the ticketed final destination. Separately purchased flights are normally separate contracts, even if an agency displayed them together.
When fixed compensation may be payable
Fixed compensation can arise after arrival at least three hours late, cancellation notified fewer than 14 days before departure, or involuntary denied boarding. Timing alone is not enough. The carrier can avoid the fixed award if it proves extraordinary circumstances and shows that the disruption could not have been avoided despite reasonable measures.
Severe cyclone conditions, air-traffic restrictions or an airport closure may qualify on the evidence. An ordinary technical defect inherent in running an aircraft generally requires a much stronger explanation than the label “operational reasons”. The airline should identify the event, connect it to this flight and explain what reasonable steps were attempted.
The July 2026 EU reform does not change this analysis yet: its relevant provisions have deferred application. The proposed future nine-month claim period is not the current filing rule.
Calculate EUR 250, 400 or 600 correctly
The established EU261 bands remain EUR 250 for flights up to 1,500 kilometres; EUR 400 for intra-EU flights over 1,500 kilometres and other covered flights between 1,500 and 3,500 kilometres; and EUR 600 for other covered journeys over 3,500 kilometres. The fare paid does not reduce the amount.
Paris–Réunion is the classic Air Austral trap. Although the route is long-haul, both ends are in EU territory. It is therefore an intra-EU flight over 1,500 kilometres and normally falls in the EUR 400 band. A qualifying long flight between a genuine third country and the EU may fall in the EUR 600 band. Compensation can sometimes be reduced by half where rerouting delivers the passenger within the statutory arrival window.
A Paris–Dzaoudzi worked example
Maya buys one Air Austral ticket from Paris Charles de Gaulle through Saint-Denis to Dzaoudzi. An ordinary aircraft fault delays the first sector, she misses the protected connection, and she reaches Mayotte four hours and twenty minutes late. Dzaoudzi is the final destination on the single contract, both destination territories are within the EU framework, and the long intra-EU itinerary normally points to EUR 400 per eligible passenger, subject to the carrier’s evidence about cause.
Now change one fact: the Saint-Denis–Dzaoudzi sector is separately ticketed. Maya’s first contract ends in Réunion. The missed second ticket is not automatically absorbed into the first EU261 calculation. She may still claim for the first flight on its own facts, but should not present two contracts as one protected connection.
Keep the other remedies in separate columns
After cancellation, reimbursement of the unused ticket and rerouting are alternatives. A passenger who still needs to travel can choose rerouting at the earliest opportunity rather than accept a refund. Care during a qualifying wait can include reasonable meals, refreshments, communications, hotel accommodation and transport between the airport and hotel. Keep itemised receipts if Air Austral does not provide assistance.
Fixed compensation is not repayment for those purchases. Nor is it payment for delayed baggage, a missed prepaid activity or every lost night of a holiday. A package organiser may owe remedies for poor performance of the package. A baggage loss or damage claim follows the Montreal Convention. Other proven financial loss requires its own legal basis, causation and evidence, with no double recovery.
Build a claim Air Austral can verify
Retain the booking confirmation, e-ticket coupons, boarding passes, disruption messages, replacement itinerary and proof of actual arrival time. Photograph airport screens where useful. Ask for the specific reason for disruption, but do not wait indefinitely before submitting the claim.
State the operating carrier, every airport, the booking reference, notification date and final arrival delay. Then list remedies separately: fixed compensation, refund or rerouting, and receipted care costs. Air Austral publishes a post-travel customer route and a distinct refund process, so using precise labels reduces avoidable confusion. Useful companion guides are:
If the response is incomplete, challenge the exact point with documents. Air Austral identifies Médiation Tourisme Voyage for eligible disputes after the required prior complaint. The French DGAC has a supervisory role, but a regulatory report is not the same as an order paying an individual claim.
Questions about the compensation claim with Air Austral
Does every long Air Austral delay qualify?
No. The flight must be territorially covered, arrival at the relevant final destination must reach the threshold, and the carrier may have a valid extraordinary-circumstances defence.
Is Paris–Réunion worth EUR 600 because of its distance?
Normally no. It is an intra-EU journey over 1,500 kilometres, for which the established band is EUR 400.
Can I take rerouting and still claim compensation?
Yes. Rerouting and fixed compensation are separate remedies, although a limited reduction can apply when rerouting achieves arrival within specified time limits.
Who pays when an Air France aircraft operated the sector?
The operating carrier is normally the target for the EU261 flight-performance claim. Check the “operated by” line rather than relying on the UU marketing code.
Are hotel and baggage expenses included in the fixed sum?
No. Reasonable care costs are claimed separately, while baggage delay, loss or damage follows Montreal rules and evidence requirements.
