Air Austral compensation rejected: how to challenge it

An Air Austral rejection is useful only if it reveals the disputed fact. Do not answer a reference to “extraordinary circumstances” with the original complaint again. Classify the refusal: wrong operator, wrong territory, insufficient delay, early cancellation notice, extraordinary cause, or missing evidence. Then challenge that point with a short legal explanation and the document that proves it.

Read the refusal line by line

Mark every factual assertion in the response. Does Air Austral say the flight was partner-operated? Does it measure arrival at Saint-Denis although Dzaoudzi was the final destination on one ticket? Does it treat Réunion as a third country, or say notice was sent 14 days before cancellation? A refusal without those particulars may justify a request for clarification.

Also check which remedy was answered. A valid refusal of fixed compensation does not decide a claim for meals, rerouting or an unused-ticket refund. Baggage and package claims belong to other legal files.

Correct territorial and operator errors

EU261 covers departures from EU territory regardless of the airline and arrivals from genuine third countries when an EU carrier operates. Air Austral is a French EU carrier. Réunion and Mayotte are EU outermost regions; Mauritius, Madagascar, Comoros and Seychelles are third countries.

Attach the coupon showing “operated by”. A UU marketing code does not make Air Austral responsible when EWA Air, Air France or another partner performed the disrupted sector. Equally, a partner brand on an agency itinerary does not displace Air Austral if Air Austral was the actual operator. Direction plus operator resolves an inbound third-country case.

Challenge the timing calculation

For delay, use arrival at the final destination on one transport contract. Arrival generally occurs when a door opens and passengers may leave, not at touchdown. If Paris–Saint-Denis–Dzaoudzi was one ticket, a protected missed connection can make the Mayotte arrival decisive. Separate tickets usually have separate clocks.

For cancellation, preserve the first notice received. If the airline relies on notice at least 14 days beforehand, ask for the transmission record and explain when it reached the passenger. With shorter notice, compare any offered rerouting against the statutory timing windows.

Require evidence for extraordinary circumstances

The carrier should identify the event, show its causal effect on the flight and explain why reasonable measures could not avoid the disruption. Cyclone conditions, airport closure and air-traffic restrictions may qualify on the evidence. “Operational reasons”, a late inbound aircraft or an unexplained technical issue is not a complete analysis.

Ask for the underlying event affecting the rotation. If weather is cited, compare the route, airport and time with reliable operational records. Even where the defence defeats fixed compensation, it does not automatically remove care and rerouting duties.

Rebuild a rejected Paris–Mayotte file

Priya travels from Paris to Dzaoudzi via Saint-Denis on one Air Austral ticket and arrives five hours late after missing the connection. Air Austral rejects the claim because the Paris sector landed less than three hours late. Her response attaches both coupons and the rebooking notice, identifies Dzaoudzi as the contractual final destination, and provides the actual Mayotte arrival time.

She claims EUR 400, not EUR 600: the journey is intra-EU and over 1,500 kilometres because Réunion and Mayotte are EU territory. She lists a reasonable meal receipt separately. This answer addresses the measurement error without inflating the amount or confusing care with compensation.

Keep the legal date accurate

As at 9 September 2026, the established EU261 regime applies. The July 2026 reform has deferred application. Its future nine-month claim period is not the present filing rule, and a rejection should not rely on it as though already effective.

Current fixed bands remain EUR 250, EUR 400 and EUR 600. Ticket price is irrelevant. A 50 per cent reduction can arise in defined timely-rerouting cases; it is not a discretionary settlement percentage.

Keep the rejection itself, its email headers and every attachment. If several passengers claimed together, list each person and the amount still disputed. A compact schedule showing the airline's stated reason, your correction and the supporting exhibit makes the review reproducible. It also prevents a later mediator from having to infer whether Air Austral disputed territory, delay, notice, cause or merely a missing document.

Escalate with a complete prior complaint

Send a concise review request quoting the claim reference and challenged sentence. Attach the itinerary, operator evidence, arrival or notice proof, receipts and your previous submission. Ask for a reasoned final response. Save delivery evidence.

Does a rejection end the claim?

No. A reasoned challenge may succeed where the airline used the wrong operator, endpoint, territorial rule or cause analysis.

Must Air Austral disclose more than “extraordinary circumstances”?

It should prove the event, its causal link and the reasonable measures relevant to the flight.

What if Air Austral measured the connection at Saint-Denis?

Show that Dzaoudzi was the final destination on one contract and provide the final-arrival evidence.

Can care expenses survive a compensation refusal?

Yes. Reasonable care is a separate duty and can remain even where extraordinary circumstances defeat fixed compensation.

Is a DGAC report the same as suing for payment?

No. Regulatory supervision and an individual route to recover money serve different purposes.
