TUI flight compensation: identify the operating airline first
A “TUI flight” can be operated by TUI Airways in the UK, TUIfly Deutschland, TUI fly Belgium, TUI fly Netherlands, TUI fly Nordic or another contracted carrier. The operating company determines who receives the statutory claim and can affect whether EU261 or UK261 applies to an inbound flight. A package-holiday booking does not remove compensation rights, but the tour organiser and airline answer different parts of the problem. Check the flight prefix and operated by line before using a TUI claim form.

Check your case in the form
Enter your route, date and type of disruption. We will check whether your case qualifies for a claim under EU 261/2004 or UK261.
What happened to your flight?
Claim up to €600 for a delayed or cancelled flight.
Choose the situation that applies to your flight:
TUI's own UK guidance says its flight-delay form is for specified TUI-operated prefixes and directs passengers flying with another carrier to that carrier. This is more than an administrative detail: submitting to the holiday brand instead of the operator can delay or misdirect a valid claim.
| Name on the trip | Common designator | Legal point to verify |
|---|---|---|
| TUI Airways | BY and operational references including TOM | UK carrier; UK261 and EU departures |
| TUIfly Deutschland | X3 | EU carrier based in Germany |
| TUI fly Belgium | TB | EU carrier based in Belgium |
| TUI fly Netherlands | OR | EU carrier based in the Netherlands |
| TUI fly Nordic | 6B and operational references including BLX | EU carrier based in Sweden |
| non-TUI airline in a TUI package | carrier shown after operated by | claim directly from that operator |
Brand, tour organiser and airline are not interchangeable
A passenger may have bought a package from TUI, received a TUI-branded itinerary and travelled on another airline's aircraft. The organiser remains responsible for package performance, accommodation and material changes under package-travel law. EU261 or UK261 liability for the flight disruption generally rests with the operating carrier.
The reverse can also happen: a flight-only customer may travel with a TUI airline without buying a package. Statutory passenger rights do not depend on purchasing hotel accommodation.
Preserve the original booking confirmation, because a later app view may display only the holiday brand. The airline designator, flight number, operating statement and boarding pass identify the company that supplied aircraft and crew.
EU261 and UK261 across the TUI airline family
Every flight departing the EU or EEA can be within EU261 regardless of which TUI company operates it. An inbound flight from a third country can also be covered when the operator is an EU or EEA airline such as TUIfly Deutschland or TUI fly Netherlands.
TUI Airways is UK-established. Its qualifying UK departures and arrivals can fall within UK261, while its flights leaving an EU airport can fall within EU261. A TUI Airways return from a third country to the EU does not obtain EU261 arrival coverage merely from the TUI brand.
This is why two customers on visually similar holidays may receive different legal answers. One may fly on a Belgian EU carrier, another on the UK airline and a third on a non-group substitute. Verify the operator for the exact disrupted sector.
Delay amount and arrival evidence
For EU261, fixed compensation uses EUR 250, EUR 400 and EUR 600 distance bands. UK261 uses statutory pound amounts published by the UK Civil Aviation Authority. A long-haul amount can be reduced where qualifying rerouting arrives within the relevant four-hour threshold.
The delay is generally measured when an aircraft door opens at the protected final destination. TUI's UK guidance expressly uses door opening rather than touchdown. Save the destination display, messages and any delay certificate requested after travel.
Package transfers do not usually extend the air-arrival clock to the hotel. If the aircraft landed at a different airport, however, necessary ground transfer to the booked airport or agreed destination can affect the analysis and expense claim.
Cancellation and a package holiday
The flight regulation provides a choice between reimbursement and rerouting after airline cancellation. The package organiser may simultaneously need to preserve or replace the wider holiday. Coordinate those decisions: cancelling only the flight can conflict with a package solution, while accepting an inferior package change may affect contractual remedies.
Fixed compensation is separate and depends on notice, replacement timings and cause. A message at least 14 days in advance normally removes the fixed sum but not the transport choice. Identify whether the organiser sent the notice promptly after receiving it from the operator.
Do not accept a voucher without understanding whether it settles the flight refund, the package or both. Ask for each remedy to be recorded separately.
Care during disruption
TUI Airways states that it provides refreshment vouchers according to delay and distance, accommodation and meals for an overnight delay, and necessary transport between airport and accommodation. Other TUI airlines have duties under the regime covering their flight.
If support is unavailable, purchase reasonable essentials and keep itemised receipts. Record the closed desk or failed contact attempts. Privately arranged luxury accommodation, alcohol and unrelated holiday losses are easier for an airline to dispute.
Care can remain due during extraordinary circumstances. A weather event that defeats fixed compensation does not automatically transfer food and hotel costs to the passenger.
Extraordinary events and operator changes
External air traffic control decisions, severe weather, airport closure and security risks can be extraordinary. Routine technical issues and the airline's crew or aircraft planning are generally operational. The responsible carrier should identify the event and reasonable measures for the specific flight.
A last-minute operator substitution does not itself cancel passenger rights. It changes the identity of the carrier against which the statutory claim is made. Photograph the gate display and keep the replacement boarding pass if the operator differs from the booking.
If TUI cites an event affecting an earlier rotation, request the timeline. An exceptional cause can lose explanatory force once normal operations resume and the remaining delay comes from recovery choices.
Claim route and AviationADR
Use TUI Airways' own delay form only when TUI Airways operated the flight. Its form requests the flight prefix, route, date, booking reference and passenger data. Include children who held qualifying bookings, while recognising that a genuinely free place can require separate eligibility analysis.
For another TUI airline, use that legal carrier's channel and the relevant national body. For a non-TUI operator within a package, claim directly from the named carrier and address package losses to the organiser.
TUI UK directs unresolved eligible airline complaints to AviationADR. Follow the current eligibility and prior-complaint conditions. Keep the airline's final response and case number.
Use the airline A-Z directory to identify an unfamiliar operator. The UK261 and EU261 comparison helps with TUI Airways routes.
FAQ: Frequently asked questions
Is every TUI flight operated by TUI Airways?
No. Several legal TUI airlines and outside partners operate package flights. Check the flight designator and operated by statement.
Who pays compensation on a TUI package?
The operating carrier normally pays the statutory flight compensation. The tour organiser can separately owe package remedies for accommodation or material changes.
Is a TUI Airways flight from Spain covered by EU261?
Yes, an EU departure is generally covered regardless of TUI Airways being a UK carrier. UK261 may also need checking, without double recovery.
Does a free child place qualify?
Eligibility depends on whether the passenger travelled free of charge under a fare not available to the public. Keep the individual ticket and price allocation for assessment.
Can TUI reject all costs because of bad weather?
No. Extraordinary weather may exclude fixed compensation, but care, rerouting and refund duties can remain under the applicable regime.
Which form should I use after an operator swap?
Use the channel of the airline that actually operated or intended to operate the disrupted flight. Attach evidence of the last-minute change.
