flydubai compensation rejected: how to challenge the answer

Short answer: A flydubai rejection should be checked against four independent points: territorial coverage, the operating carrier, delay at the protected final destination and the stated cause. A rejection may be wrong if it says a UAE airline is never covered despite an EU or UK departure, stops the clock in Dubai on one ticket, or gives only a generic extraordinary-circumstances label. It may be correct for an own flydubai journey starting in Dubai. Challenge only the disputed point with organised evidence, then use the body or court competent for the departure and claim.

Choose the situation that applies to your flight:

Convert the rejection into a list of testable statements

Separate any assertion about route, operator, booking structure, time, notice, cause, amount, passenger or deadline. Mark whether flydubai supplied a fact, a document or only a conclusion. A message saying “not eligible under European law” cannot be evaluated until it identifies the journey's starting point and actual operator.

Check that the answer covers every passenger and remedy. A voucher response may deal with ticket value while ignoring fixed compensation and care. One family member may be omitted. Build a table with flydubai's position, your evidence and one requested correction. This produces a shorter, stronger reply than resending the original narrative.

A UAE-carrier rejection can be right or wrong depending on direction

If the protected journey departed from the EU, flydubai's nationality does not defeat EU261. A UK departure can likewise enter UK261. Quote the first airport and attach the original ticket. If the journey began in Dubai and flydubai operated the inbound flight, absence of EU or UK carrier status will usually make the rejection correct under those regimes.

Do not answer a correct territorial rejection with distance or delay figures. Investigate contractual rebooking, local regulation, Montreal damages or insurance instead. For a return ticket, split outbound and inbound. This preserves a covered outbound claim without overstating the return and signals that the file has been legally screened.

Correct the operator before debating the cause

An FZ marketing number may be operated by Emirates or another partner, while an Emirates-marketed service may be physically flown by flydubai. EU261 and UK261 normally focus on the operating carrier. Attach the pre-disruption operated by wording and identify the sector that caused the loss. The replacement airline does not rewrite the original event.

If flydubai correctly redirects the claim, submit to the actual operator with the earlier response and original ticket. If both carriers deny operating, ask each to state its role and preserve the conflict for escalation. Avoid sending an identical demand to both without explaining why each appears responsible.

A Dubai endpoint may be wrong on a protected through ticket

On one booking beginning in the EU or UK and continuing beyond Dubai, a missed connection can make the last destination relevant. If flydubai says the first sector arrived only 90 minutes late, provide every coupon, through-baggage evidence, the carrier's rebooking and the final door-open time. Explain the protected booking in one sentence.

Do not use this argument for a self-transfer. Separate tickets usually make Dubai the end of the first contract, even if an agent displayed them together. A connection guarantee can support an agent claim but is not automatic regulatory through carriage. Removing that weak point can leave a valid claim for the first sector's own delay or cancellation.

Extraordinary circumstances require a causal timeline

Ask flydubai to identify the event, airport, period, affected operation and reasonable mitigation. Weather, ATC, security and airport closure can qualify, but a label alone cannot show that every later hour was unavoidable. Record when the external restriction ended and what operational constraint remained.

Routine technical issues and ordinary staffing or rotation management often lie within airline activity, subject to precise facts. Do not infer the defect from a cabin announcement or claim that other departures disprove weather. Compare like routes, equipment and times only as context. A covered journey can retain care and rerouting rights even where the fixed sum is lawfully excluded.

Escalation follows the event, not the passenger's preferred country

For an EU departure, identify the national enforcement body associated with the relevant state and check whether it decides individual disputes, supervises compliance or points to ADR. For a UK departure, consult the UK CAA guidance and any approved ADR relationship. A regulator is not automatically a court that orders payment.

Jurisdiction, limitation and pre-action requirements require separate checking. Residence or payment currency alone does not select the forum. flydubai's current conditions ask passengers to claim directly and allow up to 30 days, or any shorter applicable-law period, before third-party handling. That term does not prevent legal advice and must not override mandatory law.

A focused reply can fit on one page

Identify the booking, flight, date and passengers. Quote the exact rejection sentence. State one correction and its document, then calculate the requested amount. Ask for reconsideration and the evidence supporting any cause. Add a numbered attachment index and retain a complete copy under the same case number.

Remove unsupported passengers, duplicate receipts and an unprotected Dubai-origin leg before escalation. Record any partial payment and what it covered. A voucher, refund or hotel payment does not automatically settle the fixed claim unless a valid agreement says so. If a deadline is approaching, protect the claim through the appropriate procedure rather than waiting indefinitely for repeated template replies.

FAQ: frequently asked questions about this flydubai situation

Is flydubai correct that a UAE airline is outside EU261?

Only for some directions. A flydubai journey departing the EU can be covered; an own Dubai-origin arrival usually is not.

Is 'outside our control' enough explanation?

Not for a meaningful assessment. Ask for the event, causal period and reasonable measures.

Can I challenge arrival measured only in Dubai?

Yes, if one protected booking continued beyond Dubai and the disruption caused late arrival at the last destination.

Should I send the same claim to Emirates?

Only after identifying its role. Explain the operating carrier and disrupted sector rather than duplicating an undifferentiated demand.

Does a regulator automatically recover the money?

No. Functions vary; individual recovery may require ADR, settlement or court proceedings.
