Aeromexico and EU261: which flights are covered?
Published:
The simplest way to test Aeromexico coverage is to draw an arrow from the first airport in the disrupted direction to its destination, then write the operating carrier beside it. Aeromexico is not an EU or UK carrier. Therefore, its own flights leaving the EU can be covered by EU261 and its flights leaving Britain can be covered by UK261, but its own flights from Mexico to Europe normally are not covered by either system.

Check your case in the form
Enter your route, date and type of disruption. We will check whether your case qualifies for a claim under EU 261/2004 or UK261.
What happened to your flight?
Claim up to €600 for a delayed or cancelled flight.
Choose the situation that applies to your flight:
The passenger's nationality, residence and payment method do not change that result. This guide states the law at 9 September 2026. Although an EU reform was adopted in July 2026, application is deferred; its future nine-month claim period is not current law.
Departures from the EU
An Aeromexico-operated Madrid–Mexico City service begins in the EU, so it passes the territorial entry test for EU261. The same principle applies to an AM-operated departure from Paris, Amsterdam or another airport within the Regulation's territorial scope. Coverage does not guarantee payment: the type of disruption, final delay, notice, cause and reasonable measures still matter.
Connections must be read from the ticket. A through booking from Paris via Mexico City to Mérida may allow the final contracted destination to matter. A separately purchased Mexico City–Mérida ticket does not automatically become part of the European contract.
Departures from the United Kingdom
UK261 is a retained, separate regime. An Aeromexico flight starting in Britain can be tested under it even though Aeromexico is Mexican. The monetary bands are expressed in sterling, and escalation follows the British framework rather than an EU national authority.
Do not blend a British outbound and Mexican return. London–Mexico City starts in Britain; Mexico City–London starts in Mexico. Their presence on the same booking does not make their territorial results identical.
Flights that begin in Mexico
An Aeromexico-operated Mexico City–Madrid, Mexico City–Paris or Mexico City–London flight normally falls outside EU261 and UK261. Arrival in Europe is insufficient for a non-European, non-UK operating carrier. Buying the ticket on a European website, paying in euros, holding an EU passport or connecting onward in Europe does not move the point of departure.
That does not mean the passenger has no rights. Aeromexico's conditions, Mexican consumer routes, the transport contract and provable Montreal Convention damages may matter. They simply should not be presented as an automatic EUR 600 or UK flat award.
Codeshares can change the operator analysis
Aeromexico cooperates with alliance partners, and the flight number shown most prominently may be only a marketing code. Look for “operated by” on the original confirmation, e-ticket receipt and boarding pass. The airline physically due to perform the disrupted sector is central to EU261 and UK261.
For example, an AM-coded Mexico-to-Europe sector operated by an EU carrier requires analysis of that EU carrier, not an assumption based on the AM code. Conversely, an Aeromexico-operated sector does not become European because an EU airline marketed it. Save the original documents before rebooking creates a new operator line.
Worked route map: Amsterdam to Oaxaca and back
Liam buys Amsterdam–Mexico City–Oaxaca and return under one reservation. Aeromexico operates every sector. On the outbound, a cancellation at Amsterdam can enter EU261 because the protected direction began in the EU. If Aeromexico reroutes him and he reaches Oaxaca late, the through-booking facts and final arrival may be important.
On the return, the first flight leaves Oaxaca and connects in Mexico City before Amsterdam. Because Aeromexico, a non-EU carrier, operates the Mexico-origin journey, arrival in Amsterdam does not by itself trigger EU261. Liam should still document rerouting, expenses and contractual promises, but he should not demand EUR 600 as though the territorial test had been met.
Match each right to its legal basis.
Once coverage is established, keep remedies distinct. Fixed compensation addresses qualifying delay, cancellation or denied boarding and may be defeated by extraordinary circumstances. Reimbursement or rerouting addresses unused or replacement transport. Care covers reasonable meals, communications, hotel and transfers during a covered wait.
Package organisers may owe separate duties for combined travel services. Baggage delay, loss or damage belongs primarily to the Montreal framework and depends on proof and written deadlines, not EU261 distance bands. A clear claim identifies its basis instead of applying one label to every loss.

Frequently asked questions
Is Aeromexico an EU airline?
No. It is a Mexican carrier. That is why direction matters particularly for flights arriving in Europe from Mexico.
Is Madrid–Mexico City covered by EU261?
An Aeromexico-operated departure from Madrid passes the territorial test. Payment still depends on the disruption and other statutory conditions.
Is Mexico City–Madrid covered because it is the return half?
Normally not when Aeromexico operates it. A round-trip booking does not transfer the outbound departure point to the return direction.
What if Air France operates my AM-coded flight?
Use the operating-carrier information, not only the marketing code. An EU operating carrier may change the analysis of a Mexico-origin arrival.
Does a future nine-month EU deadline apply now?
No. The July 2026 reform has deferred application as at 9 September 2026. Existing national limitation rules remain relevant.
